EVANSTON) A 31-year-old north suburban man is dead after shooting himself in the head with what he thought was an unloaded shotgun in front of a group of friends Sunday night.
The victim—identified by the Cook County Medical Examiner’s office as Eric Zyzanski—was found “on the floor with a shotgun wound to his head. The shotgun was lying beside him,” police said.
Several witnesses told police the victim was in his apartment with a group of friends when he got his shotgun and “began showing it off” until his friends “became alarmed and told him to put it away,” the statement said.
“The victim ejected 2-3 rounds” from the gun, then “held the shotgun to his cheek, told his friends it was empty and pulled the trigger,” police said. Police said everyone they interviewed “gave consistent accounts of what had happened” and the “body and the evidence corroborated the witnesses’ accounts.”

They will shoot people who might destroy everything they worked for, places they created to make a living and to raise their families. You see a bag of pretzels, I see a business created by hard work and the motivation to better ones self. Let me ask you this, do you see a difference between ones home and ones business? Would you not defend your home from a mob who wishes to steal and burn down everything you worked for, something you rely on to feed and house your family.

If your store is looted and display cases and coolers destroyed, your family isn't seeing money coming in for a while. These shop owners don't get a payroll check. If your source of income that puts food on you table was getting destroyed, you may be compelled to protect your families livelihood.

I'm willing to point a gun at somebody trespassing on my private property that is there to do me or my employees harm. The businesses being looted aren't open for business, they are locked down. These looters aren't stealing to feed their children, they are stealing and destroying property out of blind rage. I guess you would sit back and take your chances. Good for you!

Shooting Trespassers
In general, property owners cannot use deadly force to protect property. But property owners may be able to shoot at trespassers in self-defense if they fear great bodily harm or death.
The law gives property owners the right to defend themselves with a reasonable response. That means any force used against a trespasser must usually be proportionate to harm that is reasonably perceived.
The legality of shooting a trespasser will further depend on whether you have a duty to retreat or a right to stand your ground, and the extent of your curtilage (your property surrounding your home) that counts as your dwelling.
For example, Florida lets you open fire on someone forcibly trying to enter your dwelling -- including your attached porch -- but not the rest of your property (such as a yard).
Also, since most state laws require that a trespasser knowingly or intentionally enter someone's private property, it's important for property owners to have a "No Trespassers" sign in place to serve as notice.
But remember, shooting at a trespasser is always a legal gamble. The legality of such actions is incredibly state-specific and fact-specific. Property owners could potentially be held liable -- civilly and/or criminally -- if their efforts cross the line.
