Bryan Pagliano, the State Department staffer who maintained Hillary Clinton’s private email server, is attempting to dodge a subpoena issued by Rep. Trey Gowdy (R-SC)’s House Select committee on Benghazi. The Washington Post reports Pagliano’s attorney sent a letter to the House committee which said, “While we understand that Mr. Pagliano’s response to this subpoena may be controversial in the current political environment, we hope that the members of the Select Committee will respect our client’s right to invoke the protections of the Constitution.” In other words, Pagliano is prepared to plead his 5th rather than testify. In addition, a spokesman for Senate Judiciary committee chairman Chuck Grassley told the Post, “Mr. Pagliano’s legal counsel told the committee yesterday that he would plead the Fifth to any and all questions if he were compelled to testify.” Rep. Gowdy’s staff issued the subpoena on August 11th for an appearance on September 10th. Gowdy’s committee also asked for documents related to the maintenance of Clinton’s private server. Rep. Elijah Cummings (D-MD), the ranking Democrat, complained that his staff had not been consulted before the subpoena was issued. Pagliano worked as Hillary’s IT director during her 2008 campaign. Starting in May 2009 he was hired by the State Department where he served as special projects manager to the Chief Technology Officer. That title also included responsibility for continued maintenance of Clinton’s home server. The New York Times reports that a second intelligence-community review endorses the Inspector General’s findings, and confirmed the presence of classified material on Hillary Clinton’s off-the-books email server, including multiple “Top Secret” documents. Note that there are at least two separate Top Secret breaches highlighted by the review, one in 2009 and one in 2011. There is little question that federal crimes were committed in both of these cases, as the highly classified material had to be manually transferred from a secure network to Clinton’s unsecured email server, most likely with the use of a thumb drive. Amusingly, the New York Times notes that Clinton’s campaign “disputed the inspector general’s finding last month and questioned whether the emails had been overclassified by an arbitrary process.” “On Monday, the Clinton campaign disagreed with the conclusion of the intelligence review and noted that agencies within the government often have different views of what should be considered classified,” the Times adds. The Secretary of State does not have the authority to unilaterally override security classifications, much less instruct her minions to surreptitiously violate protocols by pulling classified and Top Secret documents off a secure network and dumping them onto a computer she kept in the basement, until she shipped it to Denver for storage in someone’s bathroom.
