An investigator with the state Department of Corrections and Community Supervision was allegedly rebuffed and laughed at by the head of the agency's internal affairs unit when the investigator complained about a supervisor's sexually charged advances and inappropriate behavior.

The male investigator whose allegations are at the center of the charges gave sworn depositions accusing Ferro of harassing him over a period of years, including grabbing his genitals, hugging and kissing him, and inviting the investigator to his hotel room during work-related trips when Ferro was allegedly wearing only his underwear.

The investigator told the attorney general's office that Fonda did nothing but informed Ferro of the investigator's complaint. The investigator said Ferro responded by changing his hours and removing his ability to earn overtime. "Ferro knew this would hurt me financially," the investigator stated in the deposition. "After the experience it was clear to me Fonda would not go against Ferro. And from that point on Ferro maintained control of my schedule and Ferro made a comment that he had me 'on a short leash.'"

The Times Union reported in April that the investigation began after a female employee accused Ferro of grabbing her and allegedly threatening that it would be a "bad career move" if she filed a harassment complaint against him.
