They don't have law enforcement capabilities. And yes, it's at the presidents request, and without judicial oversight. An FBI wanted fugitives list requires a grand jury indictment, unlike the president'a capute or kill list, that is at his own discretion.(maybe you think the FBI should just start making kill lists without judicial oversight)
One more time, the CIA has no law enforcement capabilities. Al Awlaki was not killed because he violated a law, that would require criminal charges. He was killed by the CIA, an agency that does not enforce laws.
It was never the intention to "apprehend" Al Awlaki like you claimed, but to capture or kill him, based on the sole decision of the Obama Administration.
This wasn't a SWAT raid, not even close. He was on a kill list for 1 year. One year is hardly imminent danger.
How many people did he kill in that year??? I don't know either, if the answer is none, it wasn't because he wasn't trying. How many Yemeni missions were there to CAPTURE your BFFFL? I know hat there were several (likely aided by the CIA) and their conclusion was that the mission was too dangerous and would likely lead to many casualties and the likelyhood of success was minimal.
How many attempts to capture this terrorist will probably never be known. The CIA doesn't publish much and especially not their failures.
Cicero believing that this mission was illegal is irelivant. Ignoring Al awalki is as big a mistake as ignoring Osama BinLaden.

What does then Senator Obama think about the Constitutionality of capturing a US citizens without charges, shall we?
Quoted Text
Question: Does the Constitution permit a president to detain US citizens without charges as unlawful enemy combatants?
Obama: No. I reject the Bush Administration's claim that the President has plenary authority under the Constitution to detain U.S. citizens without charges as unlawful enemy combatants.
Hmmmm...But Obama put a US Citizen on a CAPTURE or kill list for 18 months without criminal charges. Ohhhh...He rejects the Bush Administration claim, not the Obama Administrations claim. Makes perfect sense.

If the terrorist could have been "detained" he would have been charged. detaining him was not possible.

Who was detaining him and for what charge? An agency that doesn't have authority to enforce laws - CIA or Military? Was the FBI involved and Al Awlaki under criminal investigation? I know he was under criminal investigation in 1999, and found nothing, no evidence of terrorism.
Box, he was on a capture or kill list for 18 months, why didn't the state bring charges against him during that time?

That's not true, we knew of his position for weeks before the drone strike. Also there was no attempt to bring him in so saying it was to dangerous is a lie, there was never an attempt. He might of been a scumbag but even scumbags are supposed to get constitutional protections, those protections were bypassed by some secret panel, that's not the America I want to be apart of.
