Stewart's Shops hit with class-action suit involving employee pay

Stewart's Shops is facing a $20 million class-action lawsuit in federal court alleging the convenience store chain violates wage laws by not paying employees for all the hours they work.
The lawsuit was filed Jan. 9 in U.S. District Court for the Northern District in Albany, NY, by a former company employee, Holly Gregory, who worked at a Stewart's near Watertown.

Stewart's Shops, a family- and employee-owned business headquartered in Malta, NY, declined to comment. The company said it had not yet been served with the lawsuit.
Gregory is represented by attorney Ryan M. Finn at Hacker Murphy LLP, a law firm in Latham.
Stewart's employs about 4,500 people and has 331 stores in upstate New York and western Vermont. Sales totaled $1.5 billion in 2012.

The lawsuit was first reported by Convenience Store News, a trade publication.
Gregory worked at a Stewart's in West Carthage as an hourly employee for several months starting in August 2013, Finn said.
During that time, the lawsuit claims Gregory regularly worked the night shift. Although the store closed at 11:30 pm and Gregory was supposed to be off-duty at 11:45 p.m, most nights she worked until 12:30 a.m. or 1 a.m. "because of the amount of work required to close the store," the lawsuit claims.

Gregory was never paid for the additional time, and when she raised the issue with her managers, "was repeatedly told that she would not be compensated for the time," the lawsuit claims.

The lawsuit also claims Gregory was not paid for time spent working during shift changes in order to ensure a smooth transition from one crew to the next, an employee policy known as "Hand Off Don't Run Off."......................>>>>.................>>>>...........................http://www.bizjournals.com/albany/morning_call/2014/01/class-action-suit-filed-against.html

retail hourly but paid salary -for "Management" positions

overtime is bad for the stores gross profit

if you work for "free" your profit sharing will be higher - this is your overtime pay

This isn't a good way to conduct business. Hopefully the powers that be at Stewarts clean up their act. What Stewarts really needs is real competition. Where are the 7-11's?

Cumberland Farms, Mobils, Hess Express, the competition is there, Stewarts must be doing something right to remain in business.

Again..........the key word in the article is ..... she 'CLAIMS'!

However.....stewarts will probably just pay her the 'alleged' loss pay (deserved or not) and call it a day.

Cheaper than fighting it in court. That's what companies usually do.

this is the new way for employees in what is called unlikely careers that pay well.....

next......ditch digging will become prominent....

This is a very, very widespread practice, and not just Stewart's.

companies 'skim' all the time....I've seen it happen.....

especially in ANY service industry.....which sucks.....5 mins of 'favor' here 5 mins of 'favor' there...for NOTHING.....

except paper 'awards' for the good selfless worker.....hahahahahahahahahahahaha

wages weren't p[aid in a few instances because someone said so......BUT........who's filling pockets now......just take a guess....

and it ain't the Board.

A service workers Union would eliminate this problem.

How so?  The DOL and a lawsuit will accomplish the same thing.  A service union will make you the union's slave.  You ever read a Union constitution and by-laws?  They're brutally restrictive on what their members can and cannot do.

no...they would just be in a club that decides what their 'fair share' is....even if you are a better worker than someone
else you only get the 'status quo' raise and get frustrated working with those who are sandbaggers.

it's an illusion to think a union moves one up and out....

are union MOVEMENTS good for a punch in the gut of the system, you betcha...but they do become stale.

having a union tell you what/how to behave is just as bad as the corporate codes....

however the union thugs will give you a blanket party if you step quicker/slower/left/right etc etc....

The lawsuit would be unnecessary.  Wage regulations are very specific so the employee would
only need to contact their union official to find out if this practice violated the employee's contract.

Unions are the reason that much of America prospered, and declining union membership is much of
the reason that the middle class is in decline.

I didn't see bankrupting the City of Detroit as one of the things you can thank a union for.
