I agree with aleiluap the McCarthy administration is up to no good as usual! The Feds need to come in and do a complete
Overhaul of our local government.The mayor has got rid of anyone that is opposed to his fraudulent government,and that alone needs to be addressed! Why doesn't he look into Philly "cheesesteak"Morris,cause this brontosaurus is taking Schenectady taxpayers for a ride! I hope one of the posters here will tip off the Feds to this disgusting abuse of power in this city!

You left out the 'hooker in my car' part. Since you failed to even address it, I'll assume this is true and the reason why you got flagged by the cops.

Like I said at the beginning of this thread, I think you should sue the crap out of the city for an illegal firing. But don't come here on these forums thinking your as pure as fresh fallen snow.

The woman known as a hooker to police was a woman who walked up from behind my vehicle and entered in the passenger side door uninvited. She asked me to give her a ride which I denied and ordered her out of my car. Within 10seconds cops pulled up. This is not unheard of in fact it has happened to numerous of our public eloyess who work in schdy. The police were clearly looking for anything or any reason to charge me with something. Being I did not solicit the woman, our conversation consisted of me demanding the woman to get out of my vehicle. If I was up to something rest assured I wild have been charged. Hence the empty beer can that was an open container charge.

If you think it was do to your complaint I wouldn't talk about it here anymore if you plan on taking legal action, talk to a lawyer first. I'm just saying that because we do have a member here who is a police officer and you don't want to say something which could harm your case.

Just be prepared in a court of law to talk about why you were hanging out in that area as 12:39AM.

Not judging, just the story you tell suggests a conspiracy, and really something the FBI should investigate.

But as I said, you'd need to be able to convince authorities that it's perfectly normal for you to be pulled over at 12:39AM at that location, on a Wed morning.

I have to disagree.  The burden of proof is on the City.  They've already admitted there wasn't enough evidence tho charge for prostitution.  So that evidence is nothing but slander.  It sounds like this person had an empty beer can in the back seat of his car with a woman sitting in the passenger seat at 12:39 am.  Certainly doesn't sound like a crime or threat to society.  

If he was invited to the SPD Christmas party with strippers and booze in a bar closed to the public, this wouldn't be an issue.  What was the disciplinary actions taken for that little indiscretion?  Oh yeah, absolutely nothing - explained away.  

Maybe he was negotiating prices with the woman in the car for a strip tease.

First.....if I had filed a complaint with 'any' police dept....I would have been more careful as to what I was doing and with who. But that's just me....heard too many horror stories.

Second....and to Henry's point....watch what you say here...check with an attorney first.

Third....as to what you or anyone else is doing out at 12:39 a.m. is NOBODY'S business!!!

Fourth....if what you say is all true....it perhaps could have been a set up which included the so called 'prostitute'. Intrapment....yes....no? Cops are famous for using the 'questionable' to make their case.

Um my point was to get any serious interest in law enforcement to investigate this as a potential conspiracy for him to be "setup", he would need to be able to explain that.

The way he tells it, it does smell of being a "setup".

I was looking at it from a wrongful termination perspective, not necessarily a "setup" or McCarthy conspiring with police to target employees he wants to terminate.  Though, I do agree, that avenue can and should be explored.  I just think it would be very difficult.

I would first file a wrongful termination lawsuit.  Even if you take what he was charged with at face value and every bit of it is true, is that enough to terminate employment?  Is it precident across the board for ALL city employees?  I can name numerous cases where police are charged with DWI's and never lose their jobs.  There are cops that are in bar fights, there are cops charged with domestic violence, and do not lose their jobs.  

I don't know how they can defend this termination on the grounds of what is essentially a traffic ticket.
