Schenectady man accused of assaulting soldier in Wal-Mart Friday, April 12, 2013
A surveillance camera at the Wal-Mart store on Washington Avenue Extension in Albany captures the alleged assault Thursday night of an unidentified U.S. Army captain by Yiqiang Wu, 47, of Schenectady.
ALBANY — An attack on a uniformed U.S. Army captain Thursday in a Wal-Mart checkout line has a Schenectady man facing a hate crime charge, police said this afternoon.
Yiqiang Wu, 47, of Schenectady, is accused of punching the captain in the Wal-Mart store on Washington Avenue Extension about 6 p.m. A store surveillance video captures the alleged assault of a U.S. Army captain Thursday by a Schenectady man at the Wal-Mart store on Washington Avenue Extension in Guilderland.
The captain, who was not identified by police, told officers the man behind him in line, Wu, began to make derogatory statements to him about the United States and the captain’s military service. Police said Wu then followed after the captain as he tried to leave the store and struck him several times in the face.
The captain sustained bruises to his face and a cut over one eye. He was treated at the scene by fire department personnel.
The incident was captured on a store surveillance camera, and Wu was arrested at the scene. He was charged with third-degree assault as a hate crime, arraigned this morning in Albany Criminal Court and released on $5,000 bail.
More likely this guy is a headcase whose family would like to get treatment for but it is short supply in this area.
Perhaps, I wish the Gazette got a statement from one of them or the cashier as to what was being said.
The Asian fellow was pretty pissed and went right through the checkout with all his items to chase the guy.
You can see him reach into his pocket just before he starts swinging. I am surprised the soldier allowed the guy to back him up so far without stopping him.
The reason it's considered a hate crime was not mentioned. It appeared to be a guy harassing the soldier, the soldier making some replies and the guy attacking him.
That's usually harassment and assault. Without the audio there is no way to know why it was specifically a hate crime.
I'm interested in knowing what words changed it into hate crime assault.
I have never heard of someone being charged with a hate crime for punching someone.
The woman who pushed the middle Eastern guy in front of the subway train didn't even get a hate crime charge.
The point I am trying to make is, was his speech before the assault the hate crime?
And would it have been a harassment hate crime if he didn't assault him?
He may have thought he was a potential "right wing" exstemist returning vet like DHS warned us about.

I'm surprised the soldier didn't punch his lights out. I sure would have, and I' pretty sure that an in shape soldier is going to fare a lot better than a 47 year old civillian.
