No it's not.  If an OSHA inspector enters a worksite and witnesses a person on a platform scissor lift without fall protection you will not receive an OSHA violation.  OSHA clearly states that fall protection is not required on scissor lifts(with rails).  It is one of the only things that has clearly defined under OSHA regulations.  The rest of OSHA's BS regulations are vague and subject to interpretation.  On the other hand, if a cops sees you without a seatbelt, it is a violation, and you can be detained and fined.

Nah...that's regulated by a seperate nanny state agency - the NYS Comp Board.  They track your experience rating within an industry that is arbitrarily determined by a bunch of useless bureaucrat that never even ran a lemonade stand.  That experience rating determines your liability and premium.  OSHA has their hand in one pocket and NYS Comp has it in the other.
