Who cares what the motive was when the crime is the same, a murder is a murder, assault is assault. If there is a mandatory sentence for murdering a cop it should be the same for a murder of a plain civilian, how is this a excuse?

A murder of a gay, black, female or all three is just a murder.  If the person was murdered BECAUSE she was
a gay black female, and no other reason, then the murder victim is just as dead, but the reason for the murder
is not your typical murder causes... so considered as a different type of crime.

For as long as laws have been in our history, punishment as well as deterring crime have been
a part of the punishment.  
1st degree murder...
2nd degree murder...
Manslaughter...
the victim is just as dead, but the reason or severity of the criminals reasons for the killing have different
punishments... as with hate crimes.


The modern conservative is engaged in one of man's oldest exercises in moral

I am not a legal expert, but I believe the intent is to bring first responders into the same category as all other individuals when it comes to murder and classifies it as 1st degree automatically, rather than possibly being classified at a lower level.  If not mistaken this is AGGRAVATED CIRCUMSTANCES, like
    Premeditation
    Murder of a pregnant woman
    Paid murderer
    Police
    Judges
    Witnesses to a crime

The degrees of murder all have to do with either premeditation or intent to cause bodily harm.
Motive, whether it is because of hate, to steal, for revenge, should be used as proof for conviction and not reason for the amount of punishment.

Why should a person get a tougher sentence because he killed a person because he is gay, rather than that he hated the red sweater the victim was wearing? despising the red sweater is still hate, just not officially designated as such.

The victim was white and the perps were black. Now, if the roles were reversed, I'd bet you a weeks pay you would have seen hate crime charges.

It's law like this that give increased punishment on what the victim was instead of the gravity of the crime that will doom any chance we have at racial harmony...my suspicion is that's not the goal anyway,

I also called Santabarbaras office got the same response, they don't know nothing.

Also when I stated a  father can't leave his child his guns , I meant if the parent dies.  

Also they want the backround checks done here in NY for private sales, but you can sell your gun to anyone in another state without it.
