Not true, at least it wasn't stated in the article. The driver of the other car tested positive.

"...Police said their investigation indicates 22-year-old Dennis Drue of Clifton Park drove his 2004 Volvo across three lanes and hit a 2004 Ford Explorer being driven by Shenendehowa senior Chris Stewart.

Stewart's vehicle rolled several times into a median one mile north of the Twin Bridges. State Police said Drue tested positive at the scene for alcohol on an alcohol breathe test. But a blood test conducted on Drue at a hospital after the crash will be used to determine his exact blood-alcohol level, including whether it was above the legal limit, law enforcement officials said....

Now reporting the bloodwork shows he was not drunk.  They are waiting on more results for "possible" drugs in the system.

Or... He was just careless and caused the wreck with out drugs or alcohol.

It certainly appears that way. The troopers will have a lot to answer for now. In a statement BEFORE the facts, they said that he was DRUNK.....which in turn caused a community (and beyond) to call for a lynching!!! Even tainting a possible jury if it ever did go to court.

Brining up smoking pot won't hold too much water either since the states are, one by one, legalizing the stuff.

It's unfortunate that this has created a MOB RULE without ever hearing the facts from the other side.

This just may end up being a very tragic accident. imo

Drue's vehicle then struck the rear of Stewart's vehicle at a high rate of speed, State Police said.

I didn't hear any report from the NY State Police that "said he was DRUNK"... What I read and heard was:

It's been reported that he had a small amount of alcohol in his system, but not enough to qualify for DWI...
So now it comes down to whether he was driving recklessly.... He retained Steve Coffey, who is already on the stump placing reasonable doubt by trying carefully place some blame on the shen students...
The key to this case will come down to whether his previous speeding convictions and license revocation will be allowed into evidence to provide a pattern of behavior...
either way, this kid is finished financially... you have four families waiting to sue him in civil court.

I agree. But i think that when kids or anyone is killed so tragically and the word/s 'drinking/drunk/alchohol/ are used.....then the 'verdict is in'....in most cases.
Some folks on facebook are using this horrific accident for the 'driving while drunk' cause....not that it's not a great cause....just sayin

a potential one...if it is found that he operated his vehicle in a reckless fashion and that was the main cause of the accident.
