TOWN OF ROTTERDAM NOTICE OF HEARING PLEASE TAKE NOTICE: That the Town Board of the Town of Rotterdam will hold a public hearing at the John F. Kirvin Government Center, V. Dalton Bambury Hearing Room, 1100 Sunrise Boulevard, Rotterdam, NY 12306 at 7:00 p.m. on the 12th day of September, 2012, upon adoption of a Proposed Local Law of the Year 2012, for the following purpose: To amend Chapter 27, Emergency Medical Board, of the Code of the Town of Rotterdam as follows: Chapter 27, EMERGENCY MEDICAL BOARD 27-1. Purpose. 27-2. Approval of formation and authorization of charter. The Town Board of the Town of Rotterdam hereby approves the formation of the Rotterdam Emergency Medical Board and authorizes the charter for said Board. 27-3. Membership; terms of office. A. The membership of said Board consists of the following: (1) Two members from the Rotterdam Town Board. (2) Two members from the Rotterdam Police Department. (3) Two members from the current town based ambulance service provider. (4) Two members from the fire department rescue squads as nominated by the Rotterdam Chief's Association. (5) Two residents at large from the Town of Rotterdam. 27-4. Officers and meetings. The Town Board shall appoint a Chairperson and a Recording Secretary. The Board shall adopt rules and procedures for its meetings. It shall keep accurate records of its meetings and activities and shall file an annual report as provided in 27-6 of this article. 27-5. Powers and duties of Board. The powers and duties of the Board shall be to: A . Advise the Town Board of the Town of Rotterdam on all matters regarding emergency medical services affecting the health, safety and welfare to the people of the town, including emergency preparedness. B. Facilitate cooperation, leadership and strong working relationships between all emergency service providers in the town. C. Promote quality patient care through collaboration. D. Advise the Town Board of the Town of Rotterdam of new development in technology, and cost saving measures affecting basic life support, advanced life support and transportation services. E. Seek to coordinate, assist and unify the efforts of private groups and individuals within the Town of Rotterdam in accord with the purposes of this article. F. Carry out such other duties as may be assigned from time to time by the Town Board and to carry out such tasks or responsibilities, consistent with the objectives of this chapter, as may be assigned by resolution of the Town Board. 27-6. Reports. The Board shall submit an annual report to the Town Board, not later than the first day of April of each year, concerning the activities and work of the Board and from time to time shall submit such reports and recommendations as may be necessary to fulfill the purposes of this article. 27-7. Compensation and expenses. The members of the Board, including ex officio members, shall receive no compensation for their services as members thereof but may be reimbursed for reasonable and necessary expenses incurred in the performance of their duties within the appropriations made available thereof SECTION 2. Maybe someone on the board could ask where the REMS repayment to the town for moneys that are owed to the town are? I'll bet not or they won't be on the boaed very long.

Section 3008. Applications for Determinations of Public Need.

1. Every application for a determination of public need shall be made in writing to the appropriate regional council, shall specify the primary territory within which the applicant requests to operate, be verified under oath, and shall be in such form and contain such information as required by the rules and regulations promulgated pursuant to this article.

2. Notice of the application shall be forwarded by registered or certified mail by the appropriate regional council to the chief executive officers of all general hospitals, ambulance services, and municipalities operating within the same county or counties where the services seeks to operate. The notice shall provide opportunity for comment.

3. Notice pursuant to this section shall be deemed filed with the ambulance service and municipality upon being mailed by the appropriate regional or state council by registered or certified mail.

4. The appropriate regional council or the state council shall make its determination of public need within sixty days after receipt of the application.

5. The applicant or any concerned party may appeal the determination of the appropriate regional council to the state council within thirty days after the regional council makes its determination.

6. In the case of an application for certification under this article by a municipal ambulance service to serve the area within the municipality, and the municipal ambulance service meets appropriate training, staffing and equipment standards, there should be a presumption in favor of approving the application.

7-a. Notwithstanding any other provision of law and subject to the provisions of this article, any municipality within this state, or fire district acting on behalf of any such municipality, and acting through its local legislative body, is hereby authorized and empowered to adopt and amend local laws, ordinances or resolutions to establish and operate advanced life support first responder services or municipal ambulance services within the municipality, upon meeting or exceeding all standards set by the department for appropriate training, staffing and equipment, and upon filing with the New York State Emergency Medical Services Council, a written request for such authorization. Upon such filing, such municipal advanced life support first responder service or municipal ambulance service shall be deemed to have satisfied any and all requirements for determination public need for the establishment of additional emergency medical services pursuant to this article for a period of two years following the date of such filing. Nothing in this article shall be deemed to exclude the municipal advanced life support first responder service or municipal ambulance service authorized to be established and operated pursuant to this article from complying with any other requirement or provision of this article or any other applicable provision of law.

7-b. In the case of an application for certification pursuant to this subdivision, for a municipal advanced life support or municipal ambulance service, to serve the area within the municipality, where the proposed service meets or exceeds the appropriate training, staffing and equipment standards, there shall be a strong presumption in favor of approving the application.

Section 3009. Continuation of Existing Services.

1. Notwithstanding the provisions of sections three thousand four and three thousand five of this article, if any ambulance service or a predecessor in interest wasin bona fide operation as an ambulance service on April first, nineteen hundred seventy-five, within the territory for which application for an ambulance service certificate or voluntary ambulance service statement of registration is made pursuant to any provisions of this article, and has so operated since that time, the department shall issue such certificate or statement of registration without requiring proof that there is a public need for such ambulance service and without further proceedings, provided application for such certificate or statement of registration is submitted to the department in accordance with this article prior to September first, nineteen hundred seventy-five. Pending the determination of any such application the continuance of such operation shall be lawful. In all other cases the application shall be decided in accordance with the procedures provided for in section three thousand four, or three thousand five of this article and such application shall be approved or denied accordingly. An application pursuant to this section shall be deemed filed with the department upon being mailed to the department by registered or certified mail.

Notwithstanding the provisions of section three thousand five of this article, if any advanced life support first response service or a predecessor in interest was in bona fide operation as an advanced life support first response service at the intermediate, critical care, or paramedic level on January first, nineteen hundred ninety-three, within the territory for which application for a certificate is made pursuant to any provisions of this article, and has so operated since that time, the department shall issue such certificate without requiring that there is a public need for such service and without further proceedings, provided application for such certificate or statement of registration is submitted to the department in accordance with this article prior to January first, nineteen hundred ninety-four. Notwithstanding the provisions of section three thousand five of this article, if any advanced life support first response service or a predecessor in interest was in bona fide operation as an advanced life support first response service at the emt-defibrillation level on July first, nineteen hundred ninety-three, within the territory for which application for a certificate is made pursuant to any provisions of this article, and has so operated since that time, the department shall issue such certificate without requiring that there is a public need for such service and without further proceedings, provided application for such certificate or statement of registration is submitted to the department in accordance with this article prior to January first, nineteen hundred ninety-four. Pending the determination of any such application, the continuance of such operation shall be lawful. Section 3005. Ambulance Service Certificates.

1. No ambulance service operating for profit, hospital ambulance service or municipal ambulance service of a city of over one million population shall operate on or after September first, nineteen hundred seventy-five unless it possesses a valid ambulance service certificate issued pursuant to this article. Effective January first, nineteen hundred ninety-seven, no ambulance service shall be operated unless it possesses a valid ambulance service operating certificate issued pursuant to this article or has been issued a statement of registration. No advanced life support first response service shall operate unless it possesses a valid advanced life support first responder service operating certificate. Effective January first, two thousand, no ambulance service shall be operated unless it possesses a valid operating certificate.

2. The department shall issue an initial certificate to an ambulance service certified prior to the effective date of this section upon submission of proof that it is the holder of a valid ambulance service certificate and is otherwise in compliance with provisions of section three thousand nine of this article.

2-a. Prior to January first, two thousand, the department shall issue an initial certificate to a registered ambulance service in possession of a valid registrationprovided that such service has been issued an exemption issued by a regional council pursuant to subdivision five-a of section three thousand three of this article.

3. The department shall issue an initial certificate to an advanced life support first response service upon submission of proof that such advanced life support first response service is staffed and equipped in accordance with rules and regulations promulgated pursuant to this article and is otherwise in compliance with provisions of section three thousand nine of this article.

4. A certificate issued to an ambulance service or advanced life support first response service shall be valid for two years. The initial certification fee shall be one hundred dollars. Thereafter the biennial fee shall be in accordance with the schedule of fees established by the commissioner pursuant to this article. However, there shall be no initial or renewal certification fee required of a voluntary ambulance service or voluntary advanced life support first response service.

5. No initial certificate (except initial certificates issued pursuant to subdivision two of this section) shall be issued unless the commissioner finds that the proposed operator or operators are competent and fit to operate the service and that the ambulance service or advanced life support first response service is staffed and equipped in accordance with rules and regulations promulgated pursuant to this article.

6. No ambulance service or advanced life support first response service shall begin operation without prior approval of the appropriate regional council, or if there is no appropriate regional council established such ambulance service or advanced life support first response service shall apply for approval from the state council as to the public need for the establishment of additional ambulance service or advanced life support first response service, pursuant to section three thousand eight of this article.

7. Applications for a certificate shall be made by the owner of an ambulance service or advanced life support first response service operating for profit or the responsible official of a voluntary ambulance service or advanced life support first response service upon forms provided by the department. The application shall state the name and address of the owner and such other information as the department may require pursuant to rules and regulations.

8. For purposes of this article, competent means that any proposed operator of any ambulance service or advanced life support first response service who is already or had been within the last ten years an incorporator, director, sponsor, principal stockholder, or operator of any ambulance service, hospital, private proprietary home for adults, residence for adults, or non-profit home for the aged or blind which has been issued an operating certificate by the state department of social services, or a halfway house, hostel, or other residential facility or institution for the care, custody, or treatment of the mentally disabled subject to the approval by the department of mental hygiene, or any invalid coach service subject to approval by the department of transportation, is rendering or did render a substantially consistent high level of care. For purposes of this subdivision, the state emergency medical services council shall adopt rules and regulations, subject to the approval of the commissioner, to establish the criteria to be used to define substantially consistent high level of care with respect to ambulanceservices, advanced life support first response services, and invalid coaches, except that the commissioner may not find that a consistently high level of care has been rendered where there have been violations of the state EMS code, or other applicable rules and regulations, that

(i) threatened to directly affect the health, safety, or welfare of any patient, and
(ii) were recurrent or were not promptly corrected. For purposes of this article, the rules adopted by the state hospital review and planning council with respect to subdivision three of section twenty-eight hundred one-a of this chapter shall apply to other types of operators. Fit means that the operator or proposed operator
(a) has not been convicted of a crime or pleaded nolo contendere to a felony charge involving murder, manslaughter, assault, sexual abuse, theft, robbery, fraud, embezzlement, drug abuse, or sale of drugs and
(b) is not or was not subject to a state or federal administrative order relating to fraud or embezzlement, unless the commissioner finds that such conviction or such order does not demonstrate a present risk or danger to patients or the public.

The County of Schenectady, located in the western portion of the State of New York’s Capital District, encompasses 206 square miles. Schenectady County has a population of 146,555 as of the 2000 Census and is the second smallest of New York’s 62 counties, excluding the counties of New York City. Schenectady County has long been an important transportation hub because of its strategic location near the state capital. There are four interstate highways and six state highways that 150,000 vehicles use daily within the County, in addition to major railroads.
Schenectady County also has an airport located in the Town of Glenville. The Schenectady County Airport is home to the 109th New York Air National Guard Airlift Wing at Stratton Air National Guard Base. Private and Air National Guard aircraft use the airport’s two runways, which are 7000 and 4840 feet long.
The Mohawk River, which is designated as part of the New York State Barge Canal System, lies within the County and divides the Schenectady County from west to east. Three locks—No. 7, No. 8, and No. 9—are located within the County. The Mohawk River and its adjacent recreational parks, biking, and hiking trails are popular tourist attractions and venues for annual events in Schenectady County.
The potential of Schenectady County’s critical infrastructure’s being a target for terrorist attacks makes homeland security a priority for the County. In particular, the County’s role as a transportation gateway between Albany and counties in the central and western part of the state makes it imperative for the County to be vigilant in preparation against potential terrorist activity.

The County’s geographical location also exposes the County to a wide range of weather-related hazards. The threat of flooding from heavy rains or dam failure is addressed on a continual basis. Additionally, severe rain, snow, ice and wind storms can tax transportation routes and private and municipal infrastructure facilities. The possibility of widespread evacuation because of a natural disaster, such as flooding, is an everyday reality faced by Schenectady County and its residents. The possibility of natural or man-made emergencies and the importance of Schenectady County as a critical component of New York State’s Capital District make it crucial that the County be able to respond to and recover from any variety of emergencies. Such emergencies may create conditions that require mass evacuations, the opening of shelters, the providing medical treatment for mass casualties, restoration of services, and recovery assistance. The Comprehensive Emergency Management Plan (CEMP) details the steps Schenectady County has taken to sustain operations and manage resources in an emergency situation.

INTRODUCTION
Schenectady County has created a Comprehensive Emergency Management Plan (CEMP) in recognition that such a plan will enhance the County's ability to manage emergency or disaster situations. County and local government officials, in addition to representatives of local businesses and non-profit organizations, participated in preparing the CEMP as a team according to the planning process recommended by the New York State Office of Emergency Management (NYSOEM). The CEMP constitutes an integral part of a statewide emergency management program and contributes to its effectiveness. Authority to undertake this effort is provided by Article 2-B of State Executive Law and the New York State Defense Emergency Act.
The development of this plan included an analysis of all potential hazards that could affect Schenectady County and an assessment of the capabilities existing within the County to deal with them.
COMPREHENSIVE APPROACH
Emergency management is an ongoing and complex undertaking. It is possible to save lives and reduce property damage through implementation of risk reduction measures before a disaster happens, preparation for disasters that allows timely and effective response during an actual incident, and the provision of short- and long-term recovery assistance after a disaster occurs. Comprehensive emergency management emphasizes the connection among the activities, functions, and expertise necessary to deal with emergencies. The CEMP provides such a detailed description of Schenectady County’s actions to reduce risk (Section II), respond effectively to a disaster (Section III), and recover from a disaster (Section IV).
MANAGEMENT RESPONSIBILITIES
This plan outlines emergency management responsibilities of Schenectady County departments and agencies according to their existing organizational responsibilities and capabilities. It designates the Office of Emergency Management to coordinate all emergency management activities of the County.
Schenectady County uses the National Incident Management System (NIMS) to manage emergencies. Homeland Security Presidential Directive 5 (HSPD-5) and New York State Governor’s Executive Order 26 make NIMS the preferred emergency management tool for the command, control, and coordination of resources and personnel in an emergency. Schenectady County and local municipal jurisdictions have adopted NIMS as the guiding document to meet federal guidelines for domestic incident management.
EXECUTIVE SUMMARY

County responsibilities are closely related to the responsibilities of the local municipalities—cities, towns, villages—within the County to manage all phases of an emergency. The County has the responsibility to assist the local governments in the event that a municipality has fully committed its resources and is still unable to manage a disaster. Similarly, the State of New York is obligated to provide assistance to Schenectady County after County resources have been exhausted. The CEMP further describes the process for requesting aid and explains how the most affected jurisdiction must commit itself fully before making a request for assistance.
Specific emergency management guidance for situations requiring special knowledge, technical expertise, or resources is addressed in appendices to the plan. Specific examples of these types of situations are emergencies resulting from hazardous chemical releases, floods, power outages, health-related emergencies, and terrorism.
CONCLUSION
The Schenectady County Comprehensive Emergency Management Plan provides general all-hazards management guidance, using existing organizations, to allow Schenectady County and its local municipalities to meet their responsibilities before, during, and after an emergency.

TOWN OF ROTTERDAM NOTICE OF HEARING PLEASE TAKE NOTICE: That the Town Board of the Town of Rotterdam will hold a public hearing at the John F. Kirvin Government Center, V. Dalton Bambury Hearing Room, 1100 Sunrise Boulevard, Rotterdam, NY 12306 at 7:00 p.m. on the 12th day of September, 2012, upon adoption of a Proposed Local Law of the Year 2012, for the following purpose: To amend Chapter 27, Emergency Medical Board, of the Code of the Town of Rotterdam as follows: Chapter 27, EMERGENCY MEDICAL BOARD 27-1. Purpose. 27-2. Approval of formation and authorization of charter. The Town Board of the Town of Rotterdam hereby approves the formation of the Rotterdam Emergency Medical Board and authorizes the charter for said Board. 27-3. Membership; terms of office. A. The membership of said Board consists of the following: (1) Two members from the Rotterdam Town Board. (2) Two members from the Rotterdam Police Department. (3) Two members from the current town based ambulance service provider. (4) Two members from the fire department rescue squads as nominated by the Rotterdam Chief's Association. (5) Two residents at large from the Town of Rotterdam. 27-4. Officers and meetings. The Town Board shall appoint a Chairperson and a Recording Secretary. The Board shall adopt rules and procedures for its meetings. It shall keep accurate records of its meetings and activities and shall file an annual report as provided in 27-6 of this article. 27-5. Powers and duties of Board. The powers and duties of the Board shall be to: A . Advise the Town Board of the Town of Rotterdam on all matters regarding emergency medical services affecting the health, safety and welfare to the people of the town, including emergency preparedness. B. Facilitate cooperation, leadership and strong working relationships between all emergency service providers in the town. C. Promote quality patient care through collaboration. D. Advise the Town Board of the Town of Rotterdam of new development in technology, and cost saving measures affecting basic life support, advanced life support and transportation services. E. Seek to coordinate, assist and unify the efforts of private groups and individuals within the Town of Rotterdam in accord with the purposes of this article. F. Carry out such other duties as may be assigned from time to time by the Town Board and to carry out such tasks or responsibilities, consistent with the objectives of this chapter, as may be assigned by resolution of the Town Board. 27-6. Reports. The Board shall submit an annual report to the Town Board, not later than the first day of April of each year, concerning the activities and work of the Board and from time to time shall submit such reports and recommendations as may be necessary to fulfill the purposes of this article. 27-7. Compensation and expenses. The members of the Board, including ex officio members, shall receive no compensation for their services as members thereof but may be reimbursed for reasonable and necessary expenses incurred in the performance of their duties within the appropriations made available thereof SECTION 2.
