Crowd control is provided when expecting large crowds.  Whether you are talking black friday retail shopping or camp bisco music festivals, both have taken steps to maintain crowd control.  I doubt Walmart is planning for Black Friday drug overdoses because they have no way of predicting and controlling what an individual decides to put in his/her body.

Lol! I think those Black Friday shoppers must be on drugs to participate in that madness!

You're right though 'cause ODs in Walmart would be unexpected so why would they or should they prepare for them...not the case for Bisco...they are a normal occurrence, they are expected...so, therefore what is the responsibility of the promoters to prepare for the expected? Do they have any responsibility? Some? None?

The promoter should clearly state on the tickets that Camp Bisco is a drug free festival and doesn't condone the use of any illegal drugs.  Maybe some signage posted on the property describing the harmful effects of drugs for those that may knowingly violate the policy.  Then have the the festival goers sign a waiver relinquishing the promoter and the Town of Duanesburg from any legal culpability for incidents in violation of the drug free policy.  

I would allow medical emergency companies compete to service an event where medical emergencies are most likely to occur.  Bid the job out to multiple competing companies and then bill the idiots that participate in the risky behavior and ultimately use the emergency medical services.  The liability should fall on the medical emergency company for any malpractice and the individual that overdosed.  If somebody knowingly poisoned a person, they should be held criminally accountable.  The promoter, the town residents, and the 99% of festival goers shouldn't be held responsible and punished for the few individuals partaking in the reckless behavior.

no, walmart IS NOT....are PUBLIC schools responsible for locking in kids for their 'perceived safety'.....

shame shame shame on us to think that someone else is responsible for our safety when the fact is that is interpersonal

keep giving it over to 'the machine' and you will lose your undershirt because it is no longer your right to have it.....

It falls under premises liability--Preventing wet floor falls, icy sidewalks, falling merchandise--retailers are responsible for providing a safe environment. Every possible danger can not be imagined and prepared for, but retailers are responsible for avoiding customer injury.

You may not agree that it should be their responsibility, but it is currently their responsibility to prevent injury.

just because something is legal doesn't make it right....WE as a society have fallen under the guise of

"they" need to do something....

it gets more lawyers and insurance companies set up in the system....do we not understand that they are
"gangsters" under the pretense of caring/protection?
