ALBANY — A 21-year-old Bethlehem man with an allegedly violent past is accused of savagely beating a 61-year-old man on Clinton Street on Sunday afternoon in the South End after the victim asked the attacker and his friends to stop selling drugs on his brother's front stoop, police said.
Nasir Stratton, of 42 Meadowbrook Drive in Bethlehem Terrace apartments, can be seen grinning in his mug shot, which was taken shortly after police arrested him in connection with the alleged gang assault that left Havie Everett lying in the middle of Clinton Street with two broken orbital bones, skull fractures, a broken jaw and brain bleeding.
On Tuesday, Everett was in fair condition at Albany Medical Center Hospital as Stratton was arraigned on a charge of felony gang assault. Stratton was being held at the Albany County jail in lieu of $50,000 bail as detectives sought three alleged accomplices.
Police said the assault happened late Sunday afternoon on the 100 block of Clinton Street, just north of Second Avenue.
Witnesses told police that Stratton and three other men were sitting on the front steps of Everett's brother's apartment dealing drugs, said James Miller, a police department spokesman.
Miller said police cannot confirm whether Stratton and the others were dealing drugs. But according to witnesses, the conflict escalated after Everett and his brother — who later went back inside the house to make a phone call — told the foursome they were going to call the police if they didn't leave.
The argument between Everett and Stratton erupted into a fight, prompting Stratton's companions to jump in and repeatedly punch and kick Everett in the head while he was on the ground, police said.
A witness summoned police, who arrived on the scene to find Everett bleeding in the street and all four of his alleged attackers gone.
A man who answered the door at Everett's brother's home Tuesday said Everett is expected to undergo surgery. Miller said the man's injuries are not believed to be life-threatening.
"They're waiting for the bleeding on the brain, the swelling to go down," Miller said.
In July 2008, Stratton and another man stood trial for allegedly robbing a man of jewelry and $800 cash outside the Twilight Lounge in June 2007.
County prosecutors' case fell apart when the victim recanted his testimony — prompting Stratton and his co-defendant, both of whom faced up to 25 years in prison, to take plea deals.
Stratton pleaded guilty to misdemeanor possession of stolen property and was sentenced to time he was already serving in prison for an unrelated crime.
A spokeswoman for the state Department of Correction and Community Supervision said she could not confirm whether Stratton had ever been there — suggesting Stratton's original case may have been sealed because he was granted youthful offender status.
