SCHENECTADY — Less than three weeks after his girlfriend agreed to testify against him, a Crips gang member admitted he fatally stabbed the woman she had been arguing with in January, according to Chief Assistant District Attorney Philip Mueller.
Perry L. Miller, 34, pleaded guilty Wednesday before Schenectady County Judge Karen Drago to first-degree manslaughter in exchange for 20 years in prison. He will be sentenced July 24.
"Taking the plea achieves certainty and seems to be a fair resolution," said Mueller, noting the DA's office also didn't want to risk that a jury might be swayed by a possible self-defense argument at trial. "There is no question his conduct caused death, but what his intent was would have been a question of nuance."
Miller's attorney, Kent Gebert, said that they too had doubts about if jurors would buy a self-defense argument in the death of Tammi Washington.
The prosecutor explained that the Jan. 30 killing began as an argument at the Salvation Army soup kitchen between Washington, 43, and Perry's 44-year-old girlfriend, Sonya Hall, over "some prior perception that one was flirting with the man of the other." That man was not Miller, Mueller said.
When Hall and Miller left the Salvation Army, Washington followed them outside and grabbed a parking lot sign that had fallen down. She swung the sign at the pair and hit Miller with a glancing blow, said Mueller. He said a livid Miller punched Washington and demanded that Hall give him the hunting knife she was carrying. Miller then stabbed Washington, twice, once in the heart. Mortally wounded, Washington managed to cross the street and tried to get help from a passerby before collapsing, said the prosecutor. She died at Ellis Hospital.
Earlier this month, Hall admitted having the knife that Miller, 34, used to kill Washington. Hall agreed to plead guilty to felony criminal possession of a weapon in exchange for her testimony against Miller. Her sworn statement to prosecutors remains sealed under court order.
