Defendants Michael Hamilton and Nicola Messere, former officers in the Schenectady, New York Police Department, appeal from judgments entered in the United States District Court for the Northern District of New York following a jury trial before David N. Hurd, Judge, convicting them of narcotics-related offenses. Hamilton was convicted on one count of aiding and abetting the maintenance of a residence for the purposes of distributing and using controlled substances, in violation of 21 U.S.C. §§ 856(a)(1) and (b) and 18 U.S.C. § 2, and one count of using a cellular telephone to facilitate such maintenance, in violation of 21 U.S.C. §§ 843(b) and (d)(1); he was sentenced principally to 54 months' imprisonment, to be followed by a three-year term of supervised release. Messere was convicted on one count of distributing and possessing with intent to distribute cocaine base (crack), in violation of 21 U.S.C. §§ 841(a)(1) and (b)(1)(C); he was sentenced principally to 27 months' imprisonment, to be followed by a three-year term of supervised release. On appeal, defendants contend primarily that the evidence was insufficient to support their convictions. Alternatively, they contend that the district court should have granted them a new trial on various grounds, including prejudicial spillover of evidence introduced in support of a count on which they were acquitted, alleged errors in the admission of evidence, and the government's alleged subornation of perjury and nondisclosure of exculpatory evidence. Hamilton also challenges his sentence. Finding no merit in any of defendants' contentions, we affirm.

There are drug dealers in Scheneectady and they are arrested wuite a bit, but, there is a demand issue - you are never really going to eradicate the drug market - what the police can do is prevent the market from negatively impacting people who want no part of that market (e.g., open air dealing, gun violence associated with the drug trade).

This series of responses from visitor reminds me of his bosom pals at the ACLU or the American Communist Party (and we DO know what your political views are since you sleep skin to skin with the democraps very closely in a twin bed) who make the argument that those arrested are "first time offenders" when in reality knows they have committed many, many offenses before finally getting caught and the vast majority of then never get caught for their crimes which tells me that even at the highest levels of these departments drug crimes are rampant. However, like the ACLU and the Communist Party these local copserv-a-crats think the public is dumb, naive and woefully uninformed as to the realities. toke toke toke down by the riverside. People know more and of course- I am only going on the say-so of other cops. So either reports are true, or many cops are liars. Take you pick. Either way in a court of law it is heresay. However, when numerous officers report things to me in disgust of the breathren, I don't expect that are also reporting it to the DA where it would also be covered up. The next federal probe may find interesting things. Who knows?
NO ONE thought the above about the cops in the report was true. Until it was proven in court. Now I have more of an open mind as to what the so-called "law" is capable of, which I did not 20 years ago when I defended the officers to the end at every chance. Naively, of course.
