SCHENECTADY — A city woman will likely serve jail time after her pit bulls mauled a woman in Hamilton Hill.
The city's law department has offered Jasmine Tirado a plea deal in connection with the Aug. 22 attack when three of Tirado's pit bulls jumped 58-year-old Shirleen Lucas on Hulett Street and dragged her, ripping off part of her ears and causing deep gashes to her head, arms and legs.
The plea agreement includes a minimum 30 days in jail, plus $1,250 in fines, $789 in reimbursement to the city and a still undetermined amount of restitution to Lucas for medical bills. Details of the offer were revealed in City Court Wednesday afternoon after attorneys for both sides spoke in private with City Court Judge Mark Blanchfield.
Tirado's dogs have already been euthanized.
The case, however, will still not be resolved for at least two months. Tirado's attorney, public defender Wendy Altonberg, said in court that her client still has many questions about the prosecution's offer. A pre-sentencing report must also be done by the Schenectady County Probation Department, and that is not due to the court until Feb. 15.
Blanchfield said the court will not accept any offer that includes less than a month in the County Jail. Mandatory jail time is a rarity in dog cases, as the city's main priority is to get money for victims. Tirado, who pleaded not guilty in September to three dangerous dog charges, is still facing up to 90 days in jail on each misdemeanor charge. Schenectady Assistant Corporation Counsel Evelyn Kinnah said the jail time offered in the plea deal is a minimum and could be increased. She said Tirado would be paying the maximum fines in connection with the charges.
Blanchfield said it appears Tirado has never been convicted of a crime. But Tuesday's offer also includes another ticket for dangerous dogs that Tirado never answered. In that 2010 case, one of the same pit bulls attacked another dog. Tirado was ultimately issued a warrant for her arrest for not appearing in court. The victim in that attack would also receive restitution under the law department's offer.

Assemblyman Jim Tedisco and Senator Hugh Farley are pushing a bill that would increase penalties so that an owner could face up to a felony, $5,000 in fines and two years in jail.
That's under the circumstances that their dog seriously injuries someone.
This law comes after 59-year-old Shirleen Lucas was attacked and disfigured by three pit bulls in Schenectady back in August of 2011.
Lawmakers say the dog's owner was recently offered a sentence of just 30 days in jail despite the fact that she had been cited twice before for harboring dangerous, unlicensed dogs.

Though this is a real problem, our elected representatives need to focus on correcting the fiscal issues that are driving the population and businesses out of NYS. Enough of the "feel good" legislation.
Reduce the number of mandated state programs that are bankrupting communities and taxpayers.
The legislature doesn't have the guts to make the hard decisions that have to be made to improve the economy, attract businesses to settle here, cut spending, and reduce taxes so they pass touchy feely laws to justify their bloated salary and benefits.

Denver and Miami have outlawed pit bulls. Ohio, by classifying pit bulls as dangerous dogs, requires owners to buy insurance and keep them fenced or caged when outside. In New York, municipalities cannot ban specific breeds of dogs.
Assemblyman Jim Tedisco and Sen. Hugh Farley, longtime Schenectady lawmakers, have proposed legislation that would make it a felony for the owner if a dog injures someone, punishable by up to two years in prison and up to a $5,000 fine.
But enforcing regulations already on the books can be difficult.

The city attorney's office made the new offer in court Wednesday. Why did the city dem judge Blanchfield go so easy on that Tirado?
The victim didn't have just a little scrape to the elbow, she's going through several surgeries.
The voters need to remember at election time (whenever his term is up fo re-election) how lenient he was in this brutal attack
Don't even think about spewing your babble DV alluding to Blanchfield should "go after the nayboobs," or anything remotely so. The residents of the city should be able to feel safe and know that these bad owners of vicious dogs will really be punished instead of a little tap on their hand. The dogs' owner will probably acquire another pitbull(s) and we'll be reading about her again.
The jerk Blanchfield tells her to use the 30 days to think about what happened, etc. HA. Tirado will be living it up, socializing with others, cable TV at taxpayer expense, exercise, etc. She'll probably go into serve her sentence and see people she knows well. Now, if they put her in a cell without her ever seeing anyone else, not allow her out of her cell, no window in the cell, no TV or radio, just give her a crayon and paper and have her write 500 times every day something like "I will never own a dog again" or something like that.
