Upon the written request of any Town officer or employee or Town resident, the Ethics Board may render a written advisory opinion with respect to the interpretation or application of this chapter or of Article 18 of the General Municipal Law of the State of New York.
B. In rendering advisory opinions, the Ethics Board may request the advice and counsel of the attorney employed by the Ethics Board or, if none, the Town Attorney.
C. An advisory opinion rendered by the Ethics Board, until and unless amended or revoked, shall be binding on the Ethics Board in any subsequent proceeding concerning the person who requested the opinion and who acted in good faith, unless material facts were omitted or misstated by the person in the request for an opinion. Such opinion may also be relied upon by such person and may be introduced and shall be a defense in any criminal or civil action. Such requests shall be confidential, but the Ethics Board may publish such opinions, provided that the name of the requesting person and other identifying details shall not be included in the publication.
D. Advisory opinions and requests for advisory opinions shall be indexed and maintained on file by the Ethics Board.
E. Any person aggrieved by an advisory opinion of the Ethics Board may seek judicial review and relief pursuant to Article 78 of the Civil Practice Law and Rules of the State of New York.
F. Any person who has submitted to the Ethics Board a written request for an advisory opinion may bring a special proceeding pursuant to Article 78 of the Civil Practice Law and Rules for an order compelling the Ethics Board to issue the advisory opinion. In addition to, or in lieu of, such injunctive relief, the person may seek a judgment in accordance with § 3001 of the Civil Practice Law and Rules determining the question posed in the request for the advisory opinion. No action or special proceeding shall be prosecuted or maintained pursuant to this subdivision unless:

(1) It shall appear by, and as an allegation in, the petition or complaint that at least six months have elapsed since the filing of the request and that the Ethics Board has failed to file any determination in the matter; and
(2) The action or special proceeding shall be commenced within 10 months after the submission of the request for the advisory opinion.

Any commissioner, member of a public board or commission, trustees, director, officer, employee, volunteer expressly authorized to participate in a publicly sponsored volunteer program or any other person holding a position by election, appointment or employment in the service of the Town or Rotterdam, whether or not compensated. what is article 18 of the public officers law??????? I cant find it.....it directs me to the ethics section but then it talks about 18 which I search and then it
tells me the ethics section.....it's a circle....

History of Rotterdam, NY
The area that is now the town of Rotterdam, New York was first settled predominately by the Dutch, about the year 1661. The town, named after the city of Rotterdam, The Netherlands, was formed from a ward of the city of Schenectady on April 14, 1820.

The fertile soil along the Mohawk River was responsible for a thriving broom corn industry during the mid-1800’s. With the advent of the Erie Canal in 1825 and later, with the coming of railroads to Rotterdam, hamlets began to spring up, including Rotterdam Junction, South Schenectady, and Pattersonville. Rotterdam was an important part of the Northeast’s railroad system. The Erie Canal traversed the entire length of northeast Rotterdam, with two locks located in the town. Athens Junction and Mohawkville were quiet, pleasant settlements in the southeastern part of town.

Rotterdam, a thriving suburban community, began as a frontier town, and now boasts hundreds of agricultural, industrial, and commercial businesses. The population has grown from 1,529 in 1820 to more than 28,000.

Established as a first class town in 1942, Rotterdam has since adopted the seal of the Old World Rotterdam, along with its motto, "Stronger Through Effort." Through diligent application of this motto, Rotterdam looks confidently to the future.

If we are a first class town FDG needs to sit down and shut up as the town board as a whole is the executive and legislative branches and he is but one small vote

Which would explain why we have a comptroller
