Bumble I am upset at the whole council and the mayor. I do not believe for one second that none of them heard the comment. Mr. Erickson a few months back at a council meeting got up and in response to a lady who was treated badly on the phone by a city emplyee well he said that all city workers should treat citizens with respect.
I though he at least would say something at the end of the meeting but no.
I put a call into most council members to get their reaction.
Mr Allen said it was uncalled for.
Brucker said she didn't hear it and didn't know if it was directed at the speaker that she was listening to the speaker and not McCarthy. well on the video she is too busy talking to Erickson. When I told her it obviously was she still had no comment, thats when the converstion went to I should call GM myself and how Mary M says things to council that are inappropriate. She totally avoided answering my question.
Rachel where do i get Roberts Rules? Is it accessable on the internet?
We had an appointment today and it went quicker so I'm home, but I heard a while back on Al's show today, it sounded like he was going to have something about McCarthy, I think he inferred a response by McCarthy. I'm guessing it hasn't happened yet because I'd think comments would be on here. You should call his show and mention your comments 476-1300 |

How do you claim it's only "alleged" ????? Alleged is defined as something that has not been proven. McCarthy's statement is 1,000% PROVEN. How can you deny that he said it when we have UNDISPUTABLE PROOF from the airing of the meeting and it's McCarthy's own voice????? Why do you refuse to explain why you claim it's only "alleged" that he made that comment? |

talked to another council member today who said nothing was said to McCarthy at the end of the meeting as they did not want to hurt his election campaign
His campaign just ended. Everyone's talking about how he imploded in front of every TV camera. What was he thinking? He can be a seat warmer until November but that's it. |

The video is posted. I have a recorded copy of McCarthy saying what he did at the council meeting and many others do too. What don't you get...what a bobble head.
I read your posts here and can't believe there are folks like you out there.
uh oh I called you a name. Call the State Police, call the Militia, bring in the FBI, get the dogs and helicopters oh no.
You are a hoot. Thanks for the entertainment. |

JUst have been reading around. It is apparent McCarthy has responded, oh, wait, it is alleged that McCarthy responded. McCarthy's alleged response to the insulting comment he made to a citizen during the meeting (a comment which is proven to have occurred) is basically that McCarthy allegedly knows the speaker by virtue of his position in the DA's office, and McCarthy allegedly said that the speaker's comments were baseless.
Al Roney did just touch on it. And it's on the Time Union website.
Practice at the council meetings generally when someone brings some information with them (proof, evidence, petition, etc), the council president will ask someone close by to take it (assuming the speaker is trying to give it to the council), and the council president will say they'll look at it, pass it on to appropriate department head, etc. If a citizen is speaking about the issues and it is obvious that the citizen has more to say (which needs to be heard), the council president will usually ask the appropriate department head to meet wtih the citizen in the hallway, right there and then. Or sometimes the council president might ask the citizen if he/she can stay at the end of the meeting and he (the council pres) will discuss the issue a bit more.
There is that Barbara Katz, we see here come to the mic and think to ourselves "oh gosh, what's her beef now." Her comments the other night about the unshoveld sidewalks and bus stops are valid. But I've also heard her before saying things like the kids are riding their bikes the wrong way (that one she mentions frequently), unfortunately I don't know what she means by "the wrong way" (riding on the wrong side of the street? riding on the sidewalk? two on a bike? etc). On this particular bike riding issue, even if the kids are riding the wrong way, it's something that I often think, gosh, if the cops started spending their time dealing with kids riding their bikes the wrong way, they'd never have time to address real crimes. She often says there should be a market downtown, a shoe store, and a store where she can buy a mop. We look at each other, knowing that we do not live in a communist country, we do not live in a socialist country, therefore it's not up to the city to get such stores. That is the private sector responsibility. We do not have government grocery stores, government shoe stores, or goverment stores where people can buy a mop. That all said, and as "wacky" as may of us might SOMETIMES think she is, no council president has ever made a comment after her speaking such as suggesting she contact private sector businesses, nor something finding the bicycle police or similar.
I remember that Joseph Rosamino who really was playing to the TV cameras, no insulting comments to him. Who remembers Betty Lou Phillips. She's a real piece of work, she and her mother would be several aisles away from each other Walmart (Rotterdam) and they'd be yelling at each other as they zipped around on their mart carts. She used to be a fixture at every meeting yet regardless of what she would say, it would NEVER be acceptable for a council president to make any snide remarks when she's walking back to her seat.
In fact, no matter who the speaker is, no matter what council people think about the speaker or the message they are giving, none of them should ever laugh at the person when the person is speaking, none should ever roll their eyes, shake their heads, or use any body language to express that they are annoyed with the speaker for any reason. Speakers, regardless of the content and reason, deserve respect. |

Furthermore, in the issue of this Donald Burch (or however his name is spelled).
From things I've heard and read from other sources, it is alleged that McCarthy made some comments about Burch allegedly alluding to infomamation McCarthy allegedly knows from his position in the DA's office.
Any information (about a "client," and unconvicted person who has charges pending, a person with a past) obtained through one's job in the DA's office should remain confidential and must never be publicized or commented on by a DA employee outside of the working hours of the DA employee when the DA employee is acting in the capacity of his/her employment in the DA's office. In fact, generally in government, there is an official spokes person who responds with the official statement of that government department,
If this Donald has any case in the DA's office right now, he should immediately demand some change of venue type of action based on McCarthy's comments.

mike So very well said : )
regarding Katz and Phillips etc. even though others might not understand quite what their comments were about , the important thing is they took their time to go to the meeting, they had a complaint or comment they thought important and they had their say. And Ms Katz looks so very frail and I give her so much credit for what must be a hard time getting to the meeting.

Here is another point to be made.
The DA's office handles criminal cases, the DA's office does NOT judge people's mental capabilities. ANY indication that a "customer" of the DA's office might have mental health issues is referred to appropriate government or private mental health professionals for evaluation.
Once a person has been evaluated, that information is CONFIDENTIAL. Any publicizing it would most likely be a violation of HIPPA laws. Therefore, McCarthy violated federal law with his comments - once comment (the one he made at the meeting is proven, while the other referenced in the TU blog is alleged at this point).
This Mr Burch could go to apply for a job later this week and suppose the interviewer saw the council meeting, if Burch was otherwise acceptable, the interviewer might opt not to hire him based on McCarthy's comments.

A council member told me they might have to tape his mouth shut.
But I'm glad we all got to hear his comment as now we know his prejudice against those with mental illness.
And Mike I was thinking the same that he violated law saying in public anything he knew about this young man from his work at the DA's office.
# # Criminal Penalties. A person who knowingly obtains or discloses individually identifiable health information in violation of HIPAA could face a fine of $50,000 and imprisonment for up to one year. If the wrongful conduct involves “false pretenses” the criminal penalties could increase up to a fine of $100,000 and up to five years imprisonment. A fine of up to $250,000 and up to ten years imprisonment could be imposed if the wrongful conduct involves the intent to sell, transfer, or use individually identifiable health information “for commercial advantage, personal gain, or malicious harm.”
