Ex-caseworker falsified records, also endangered child, indictment alleges

SCHENECTADY -- A fired Schenectady County caseworker faces charges she allegedly falsified paperwork and lied to police looking into allegations of the neglect of a malnourished infant boy in the city of Schenectady, authorities said.

Milagros Noriega, 47, is charged in an indictment with official misconduct, making a punishable false written statement, offering a false instrument for filing, and endangering the welfare of child.

The details of what records she allegedly falsified and how they fit in with the case she handled were not available from the indictment's language or authorities.

Noriega formerly worked for Child Protective Services, County Attorney Christopher Gardner said. The agency is responsible for investigating allegations of abuse or maltreatment of children caused by the actions of a parent or caretaker, according to information on the county's website.

The indictment was unsealed Friday by County Judge Karen Drago.

On the last offense, the indictment alleges that between April 8 and June 18, 2010, the defendant "knowingly acted in a manner likely to be injurious to the physical mental or moral welfare of a child" under the age of 17 at a house on Stanley Street.

Schenectady County also needs a new County Manager, new Finance Commissioner and especially new majority leader for the County Legislature.

      A leading DEM compared this County to The Sopranos when Tony needed to pick a new capo for Juniors crew. Pickings are mighty slim. Too much deadwood merely padding State retirement accounts.

Caseworker lied about family visits, county official says

    A former Schenectady County Social Services caseworker facing felonies is accused of falsifying visits to a mother and child, a county official said Monday.
    The alleged deception wasn’t discovered until the mother came for an in-office visit with the child last June and another worker noticed the child was obviously in distress, Schenectady County Attorney Christopher Gardner said. The child was rushed for treatment.
    The worker on the mother’s case, Milagros Noriega, was immediately placed on administrative leave, Gardner said, and an investigation showed she lied about visits to the mother. Her last day employed with the county was July 2.
    “She was making false entries in her reports indicating that she was doing home visits that she never actually conducted,” Gardner said.
    “There’s no reason for it,” Gardner said later.
    A criminal investigation ensued, resulting in Noriega being indicted and arraigned Friday on multiple charges, including felony falsifying business records and offering a false instrument for fi ling. She also faces misdemeanor official misconduct and endangering the welfare of a child counts.

SCHENECTADY -- A caseworker for Schenectady County Child Protective Services who is facing criminal charges related to an alleged child-neglect case is disputing claims that she lied last year about making home visits and taking a severely undernourished infant to the doctor.

"I made the home visits," Milagros Noriega said during a telephone interview Monday about accusations that surfaced last week when a six-count indictment was unsealed and she was arraigned in County Court on charges of official misconduct, endangering the welfare of child, making a punishable false written statement, offering a false instrument for filing and falsifying business records. "Everything was completely stable in the house," she said.

Noriega, 47, also said she wanted to set the record straight that she resigned on July 2, 2010 and was not fired, as officials initially said.

But on Monday, County Attorney Christopher Gardner said Noriega was forced to resign or be fired after a criminal probe revealed she made what he described as "blatantly false entries."

"Her story changed many times during the course of the investigation," Gardner said Monday. "She didn't do all the home visits and was fabricating that she was taking the baby boy to the doctor."

He said the boy suffered from a digestive problem that may have made it difficult for him to eat, and that regular doctor visits could have caught the problem earlier. The child, who will be a year old in April, is now doing well in foster care, authorities said.

    The Schenectady County social services case worker accused of lying about visits to a city mother lied about a previous interaction with the mother, causing the mother to lose one of her children until her attorney could intervene, the attorney alleged Friday.
    Family Court attorney Patricia Rodriguez alleged Friday that case worker Milagros Noriega falsely translated her client Lucecita Alvarado’s answer to a request to give up rights to an older child. Noriega instead told a supervisor that the Spanish-speaking Alvarado consented to the removal, Rodriguez said. The older child spent a week away from the mother before Rodriguez could successfully argue that Alvarado never consented to the removal.
    Social services returned the child to Alvarado without forcing a hearing, Rodriguez said.
    “It was appalling, I’ve never had a case worker misrepresent what a client said like that,” Rodriguez told The Daily Gazette Friday. “It was pretty egregious. I just thought it was horrible.”
    Rodriguez said she made verbal complaints about the issue, did not know what became of them, but Noriega remained.
    Noriega faces indictment on a host of charges, accused of falsifying visits to Alvarado and her infant child Kevin. Noriega was immediately placed on leave and later forced to resign after the infant child was discovered June 18, 2010 severely malnourished, suffering from dehydration and heart failure.
    The mother also faces charges. Alvarado was arrested in June and charged with fi rst-degree assault, accused then of causing serious physical injury to the infant by failing to provide proper nourishment and medical attention to the child, according to papers fi led in court. She was accused of endangering the child between May 7 and June 18, 2010, beginning when the child was a month old. remember to always trust the government.....at some point you dont even have to bother making an effort because 'the machine' is against not

I work with some folks who have had to deal with CPS and ALOT has to do with supposed A.D.D. kids and the not taking of meds in the city schools...
CPS gets VERY involved....it is gangster mentallity of the most egregious sorts.....that is how they 'manage' the kids in the schools....sad sad sad
sham sham sham......the mother just pretty much gives up trying because no matter what choice they make someone else tells them it's 'not good
enough'....that is mental anguish, dehumanising, demoralising and WRONG....WRONG....WRONG.......we talk about 'war criminals' take a look here....
the mother is bullied because the CPS worker has to show the did an 'intervention' because of our litigical society,,,,both ends of the spectrum never
learn to make choices and quite frankly are stifled to the the inability to reason....who suffers? everyone involved.....

Sender-my young niece recently was "diagnosed" by the school psychologist as having ADD. Medications brought up which my sister refused, they didn't like that. My nieces  mind does wander at times, but didn't we all daydream in school?  Thinking about after school etc or the newest record or whatever.

When I worked at a Sch'dy school the kids lines up for meds. Very sad to see the kindergartners walking around like little robots, some falling asleep at the lunch table: (

My son has Tourettes. long story about my fight with the school district, but first the psychologist and social worker dismissed his diagnosis even though I had a letter from the pediatrician. Because they did not see him ticcing all the time they felt he didn't have it. Even after I explained that he supressed them until he got home and then his tics would explode.

I was fortunate to have a lady from the National Tourettes Association come to the school. The meeting was scheduled way in advance. alll teachers notified as was the social worker and psychologist, principal etc. Only TWO showed up. The lady said she had NEVER seen such a small showing and said it was the worst school she had ever visited, she couldn't believe how uncompassionate they were. I could as went through it for many years.

Mom pleads guilty to reckless endangerment

    The local mother charged with failing to provide her infant child proper nourishment and care, to the point where the child almost died, pleaded guilty to a felony Monday.
    Lucecita Alvarado, 39, of Stanley Street, pleaded guilty in Schenectady County Court to one count of first-degree reckless endangerment and could get a sentence of as little as time served, or about eight months.
    The plea came after revelations of allegations against Alvarado’s one-time social services case worker.
