The Schenectady police chief’s nephew has been indicted on a murder charge. Tyrone Chaires, 24, who grew up in Scotia near his uncle’s home before moving to Troy in 2008, was indicted Thursday on one murder charge and two counts of possession of a weapon. He is accused of shooting a man in the head in Troy just more than a year ago. But unlike most suspects in murder cases, Chaires was not called to court immediately to face the charges. His arraignment has been set for Wednesday. His attorney, Terence Kindlon, said he has never had a client go free for a week after being indicted on murder charges. “And that’s in my 40 years of experience handling murder cases,” Kindlon said. “It struck me as peculiar.” Rensselaer County Assistant District Attorney Arthur Glass said Chaires didn’t cause trouble or run while police investigated him all year. “Of course, that’s always a fear,” he said of Chaires possibly fl eeing. “But we’re mindful he’s been released in the community for the past year.” He said he’ll also ask the court to set bail. In many murder cases, the prosecution asks the court to hold the accused without bail, on the grounds that someone facing such a serious charge could be a danger to the community or a fl ight risk. Glass said the decisions regarding Chaires’ freedom had nothing to do with the fact that his uncle is Schenectady Police Chief Mark Chaires. “Absolutely not. That relationship has no consideration in this,” he said. Police chief’s nephew jailed in murder case TROY — The Schenectady police chief’s nephew is now in jail without bail, facing a murder charge. Tyrone Chaires, 24, was ordered held without bail after being arraigned in Rensselaer County Court on a murder charge and two counts of possession of a weapon. He is accused of shooting a man in the head in Troy just more than a year ago. Chaires was first arrested on those charges shortly after the shooting but had to be released several days later because the district attorney’s office did not have enough evidence to prove he should be held. When a grand jury indicted him last week, he was not immediately arrested but was allowed to remain free until his arraignment seven days later. It was an unusual privilege, one that Chaires’ attorney said he had never seen in 40 years of defending murder suspects. Rensselaer County Assistant District Attorney Arthur Glass said that Chaires’ treatment was not connected to the fact that his uncle is Schenectady Police Chief Mark Chaires, although he suggested that the elder Chaires was keeping an eye on Tyrone Chaires. He said he was willing to let Chaires go free until his arraignment — and even ask for bail to be set at the arraignment — because he was “residing at his family home.” He also noted Chaires had done nothing wrong since his arrest last year and had not fled the area. Murder suspects and others who might be a flight risk or a danger to the community can be held without bail, if so ordered by a judge.
