COLONIE -- A town judge Wednesday morning dismissed a charge that Schenectady police Officer Darren Lawrence left the scene of a car crash four years ago.

Judge Norman Massry said there wasn't enough evidence presented at Lawrence's trial to prove he was driving when the vehicle overturned and landed in a ditch on Oct. 14, 2006.

Now, Lawrence faces second-degree harassment, a violation.

Lawrence was accused of leaving the scene of a personal injury accident, a misdemeanor, and harassment, a violation, after the accident.

But his defense attorney, Michael McDermott, said another man, Mark Viscusi, was behind the wheel of the 2000 Mitsubishi when the crash occurred on Watervliet-Shaker Road during the early morning hours.

McDermott's version events was disputed by prosecutors.

"This is a case about taking responsibility," Assistant District Attorney Lincy Jacob told a six-member jury Monday.

The jury delivered its verdict Wednesday after a judge dismissed another charge that accused Lawrence of leaving the scene of a car crash.
