Mother accuses district workers of beating son

    A young student’s mother is suing the Schenectady City School District, saying a teacher and social worker punched her son while restraining him.
    Cindy Wiles, mother of elementary school student Austin Lupinski, has filed papers in state Supreme Court, Schenectady County. She is asking the school district for $250,000.
    The lawsuit accuses Woodlawn Elementary School special education teacher Joel Villa and social worker Harold Sperazza of beating Lupinski.
    They “forcefully and aggressively” restrained Lupinski, according to the lawsuit, by pining him to the fl oor.
    Then they punched him and twisted his arms and legs, according to the lawsuit.
    Lupinski has ADHD, a form of hyperactivity, and has been diagnosed with emotional disabilities, his mother said. But she said in the lawsuit that the boy did not provoke the incident. She accused the teachers of maliciously attacking her son.
    The incident aggravated his emotional problems, she said, and hurt her relationship with him as well.
    The incident occurred on Dec. 14, 2009. She filed a notice of claim on Feb. 2, 2010, but the school district declined to settle.
    School officials declined to explain what happened on Dec. 14, but said the teachers did not assault Lupinski.
