No. 217.10 Appoint Rachel E. Manning of Rotterdam Junction, New York as Dispatcher for the Rotterdam Police Department, full-time, probationary, with full employee benefits, at an annual salary of $35,845.74, effective August 11, 2010. PUBLIC HEARINGS: A. To amend §266-52, Schedule XII of the Code of the Town of Rotterdam entitled, “No Parking at Any Time” by amending as follows: In accordance with the provisions of §266-20, no person shall park a vehicle at any time upon the following streets or parts of streets: Name of Street Side Location Sixth Street North Across the street from 1053 Sixth Street Public Hearing was called for on July 14, 2010. B. For location in the Aquifer Overlay (AO) Zone for PC Development Group, LLC, to construct a multi-use building with an office and a bank with a drive-thru and location of a second building with a fast food restaurant and associated drive-thru. To add to Chapter 270, a Landmark and Historic Preservation ordinance relating to the establishment of protection for the prehistoric, historical, and cultural landmarks in the Town of Rotterdam, Schenectady County. To add a local law adopting Part A of Chapter 105 of the 2010 Retirement Incentive Program to provide eligible employees with one additional month of service credit for each year of service as of the date of retirement, with a cap of three years credit. Public Hearing held at Town Board meeting of August 11, 2010. 220.10 Refer to Planning Commission for report and recommendation thereon a proposed Local Law of the Year 2010 for the following purpose: To amend §270-215 of Chapter 270 entitled “Erosion and Sediment Control” and to amend §270-5 of Chapter 270 entitled “Definitions” of the Code of the Town of Rotterdam. 221.10 Refer to Planning Commission for report and recommendation thereon a proposed Local Law of the Year 2010 for the following purpose: To amend §270-151 of Chapter 270 entitled “Signs” and to amend §270- 5 of Chapter 270 entitled “Definitions” of the Code of the Town of Rotterdam. 222.10 Declare the Town of Rotterdam as “lead agency” and authorize the Town Planner to prepare, file, publish and distribute all documents necessary to comply with 6 NYCRR Part 617 & State Environmental Quality Review relative to the below-referenced amendment to the Code of the Town of Rotterdam for a Comprehensive Plan Amendment and change of Zone request as outlined in Resolution No. 221.10 below. 223.10 Call for a public hearing to be held on Wednesday, September 8, 2010 at 7:00 p.m. at the John F. Kirvin Government Center, 1100 Sunrise Boulevard, Rotterdam, New York 12306 for the following: For a Comprehensive Plan Amendment and Change of Zone request from the Town of Rotterdam on an approximately 3.6 acre parcel from Retail Business (B- 1) to Multi-Family Residential (R-3) to facilitate the redevelopment of the former Draper School property located at 901 Draper Avenue, Rotterdam, New York 12306. 224.10 Accept the 2009 Audit Report from Cusack & Company Certified Public Accountants, LLC, located at 7 Airport Park Boulevard, Latham, New York 12110. 225.10 Authorize the Supervisor to accept the Early Retiree Reinsurance Program (ERRP) as administered by Benetech, located at One Dodge Street, North Greenbush, New York 12198. 226.10 Authorize the Supervisor to appoint an additional Deputy Town Clerk in the event of an absence of the Deputy Town Clerk. 227.10 Authorize the Supervisor to enter into an agreement with the Board of Directors and the Captain of the Duanesburg Volunteer Ambulance Corps, Inc. in connection with the Rotterdam Police Department (“RPD”) and the Duanesburg Volunteer Ambulance Corps, Inc. (“DVAC”) for the Purposes of Advanced Life Support Services. 228.10 Authorize the Town Attorney to enter into a Settlement Agreement in the matter of Frank Wilcox vs. Town of Rotterdam Index # 2009-1649 Article 7 tax proceeding for the tax year 2009. 229.10 Authorize the Town Attorney to enter into a Settlement Agreement in the matter of Dino Viscusi vs. Town of Rotterdam Index # 2009-1629 Article 7 tax proceeding for the tax year 2009. 230.10 Authorize and direct the Comptroller to appropriate to the Water District Number 5 Fund, unrestricted fund balance (SW5-599) in an amount not to exceed $75,000.00 in the 2010 budget. 231.10 Upon the recommendation of the Town Designated Engineer and Town Highway Superintendent, accept as a Town road Kingswood Court, with related utility easements and stormwater management area in the Town of Rotterdam. CONSENT ITEMS: Res. No 232.10 The Town Board of the Town of Rotterdam authorizes John M. McDonald Engineering, P.C. to call for bids for the Town of Rotterdam Wastewater Treatment Plant Trickling Filter Repairs. 233.10 Authorize Supervisor to execute an agreement with the City of Schenectady Police Department for the Town to allow the City use of its outdoor shooting range. 234.10 Authorize Supervisor to execute rental agreement with Mother Goose Nursery, Inc. for the Senior Citizens Center in the amount of $325.00 per month for a period of nine (9) months commencing September 1, 2010 through and including May 31, 2011. 235.10 Authorize gasoline expenditures from April 1, 2010 through and including June 30, 2010 to be transferred into various accounts. 236.10 Accept the Town Clerks Report for the month of July 2010. 237.10 Authorize Comptroller to declare certain office equipment obsolete. 238.10 Budget transfers by the Town Comptroller to various accounts. What's that agreement about?
This "agreement" means that our Rotterdam Paramedics would provide ALS services for DVAC...the only question is who would pay for it? DVAC is a volunteer squad that operates on limited funds...so I would imagine that Rotterdam or DVAC would, and should, bill the users...just as Mohawk would do if they were to become our primary EMS provider and our paramedics were unable to respond to a call involving the potential for ALS service.
Don't be surprised if this breeds more calls for another tax district...this time for ALS specifically...just as the original tax scheme for Rotterdam is falling apart.
226.10 Authorize the Supervisor to appoint an additional Deputy Town Clerk in the event of an absence of the Deputy Town Clerk.

This resolution was removed from the agenda at the agenda meeting on Monday...as was the ALS resolution, the resolution calling for another full time dispatcher, and the resolution concerning early retirements.
There just won't be a Second Deputy Clerk this month. Wait till next month.
