State legislators have been a bust when it comes to dealing with the budget crisis, but — surprise, surprise! — they haven’t exactly been sitting around doing nothing. In fact, the Senate passed legislation Tuesday that would do something quite positive: modernize the state’s antiquated divorce laws. New York is the last state in the union where couples seeking divorce either have to have concrete grounds — typically adultery or abuse — or they have to separate and wait a full year to be granted divorce on the grounds of irreconcilable differences. This law has caused innumerable people to lie under oath that they’re at fault or relocate to other states, not to mention dragging out a process that’s emotionally trying and expensive under the best of circumstances. In every other state, a couple seeking an uncontested divorce is granted one — no questions asked. And as long as both parties agree that the marriage isn’t working, and they’ve reached agreement over the division of marital assets and custody, why should it be any of the state’s business?
