Rotterdam Town Clerk absence causes controversy
February 15, 2011 5:33 PM
Randy Simons

ROTTERDAM-  Rotterdam residents are raising questions over the absence of their longtime town clerk.

Eunice Esposito has served the town since the late 1970's and was re-elected to her post in March 2010.  However, shortly thereafter in April 2010 she left on medical leave and has been out since.

While on medical leave she is still collecting her $50,000 plus salary as she is entitled to by law according to Town Supervisor Frank Del Gallo.

"An elected official has to work one day a year and they get paid. No matter who it is" says Del Gallo. "It's a pretty tough thing if you were out sick and the boss said you couldn't get paid but the law says you could."

While Rotterdam residents aren't questioning Esposito's illness they are questioning how long the town can afford to pay a salary to an employee who is not showing up to work.

"She has three more elected years to her term" says longtime Rotterdam resident Richard Malaczynski. "It's a little over $50,000 a year which amounts to $200,000 over the course of her current term. We're a little concerned about paying that kind of salary for one days worth of work in a year."

The town says they are currently working with their attorneys to see what options they may have to handle the situation under the law.

"Maybe it would be a wise thing to do to continue the legacy of good service to the town and possibly consider giving up the office and not forcing taxpayers to continue to pay that salary for the next three years potentially" says Malaczynski.

Town Supervisor Frank Del gallo says he recently received indication that Esposito may be able to return to work in April.

One thing everyone can agree on is that they wish Eunice Esposito a healthy recovery.

there's no time like the present to hash out the entitlements given the gumbas and taken advantage of....EE is a nice person as far as I know her...
but no matter who is in that chair will get this dumb-a$$ legal right.....WE CANT AFFORD IT!!! AND IT BETTER NOT HAPPEN AGAIN!!!! AND.........
those from the past who voted her salary and the legal right to do what she did(including herself) should stand before the townfolk and explain and
apologize for their short-sighted gumba familia ........ we demand it....

doesn't this town look stupid now.....thanks alot

FDG should take his own advice and consider his one day of service as an elected official fulfilled. Based on my math, FDG has served 410 days more than he had to, and 411 day more than the people are now realizing he should have served.

The only thing I can add is that Mr. Malaczynski should take his earmuffs off for the next TV interview. He was gracious and spoke fairly and eloquently about a sensitive topic which I find is more and more the subject of conversation in the town where ever I go. I think he phrased it nicely, with respect, and without malice in any way.

"Maybe it would be a wise thing to do to continue the legacy of good service to the town and possibly consider giving up the office and not forcing taxpayers to continue to pay that salary for the next three years potentially"

"While Foreign Terrorists were plotting to murder and maim using homemade bombs in Boston, Democrap officials in Washington DC, Albany and here were busy watching ME and other law abiding American Citizens who are gun owners and taxpayers, in an effort to blame the nation's lack of security on US so that they could have a political scapegoat."

Perhaps you weren't outside today.........it was FREEZING OUT and the WIND WAS WHIPPING!!

I like the end of the video when FDG said EE would be returning in April. Then the reporter asks if the doctor said that she could return then. FDG's comeback.....'well SOMEBODY did'!!

You folks just don't like the fact that I  DO think for myself.   You really are a bunch of losers.

Losers?   A guy with no job, living off the taxpayers dole, not even to be a responsible independent adult owning a house (nor even making the remotest attempt to buy a house in the city he claims is so wonderful), but we are the losers?   We are the people who are adults, raising our families, involved with our children's schools, owning our homes, taking care of our properties, paying high taxes of our own and we pay the county taxes of millionaires (some pay the city and school taxes for the millioniares as well).

We are winners.  We are trying to make a difference.   Winners are the people who care about their communities and don't like seeing political cronies exploiting the taxpayers, robbing taxpayers of their hard work by giving taxpayer handouts to millionaires.  Winners know that it's totally wrong--morally, ethically, and socially--for politicos to keep secrets from the citizens.   Winners are the people that get the word out, crack open all the secrets of the political cronies.

Losers are the ones living on the taxpayer dole and cheerleading robbing from the taxpayers and giving to the millionaires.   Rather hard to handle isn't it.  Rather hard to handle that all the mis-use of taxpayers' money as well as the bad deeds of the elected officials, and the employees who employed by the taxpayers who are doing criminal or near criminal acts

Optimists close their eyes and pretend problems are non existent.
Better to have open eyes, see the truths, acknowledge the negatives, and
speak up for the people rather than the politicos and their rich cronies.

come on DVoR there has to be a solution to the Eunice Issue

(3) Removal from office. This is accomplished by a court upon application for
removal made by any citizen-resident or by the district attorney upon notice to the town
officer and with a copy of the charges. (The standard is misfeasance, malversion or
maladministration of the office. Courts are reluctant to reverse the will of the electorate,
so the degree of misconduct shown must be substantial.)

imagine the paperwork above

(4) Ceasing to be a resident of the town. If, while holding office, the town officer
moves out of the town and takes up residence elsewhere, the office becomes immediately
vacant by virtue of such move. Note that "residency" essentially means domicile. No one
factor controls, although intent is key. Thus, temporary absences may not terminate one’s
residency.

this one is harder

(5) Conviction of a felony or of a crime involving one's oath of office.

almost scored this one

(6) Entry of a judgment or court order declaring the officer to be insane or
incompetent.

this one is not too far off

(7) Judgment of a court declaring an election or appointment void or finding that an
office is forfeited or vacant.

neither is this last one

sit down with your team and work this out

name michele or yourself and be done with it

wasting my hard earned money like this is just stupid

oooo Ron Severson, B.S. in pre-law is going to sue you. You should be scared Mike...

Hey Ron here's a little dose of what I call the facts you criticize everyone you libel everyone, most especially Mr. Parisi. If anyone should be sued it is you, you overweight, ugly, unmarried, man with no assets, no job, attempting to get on the dole (kinda funny you champion FDG then he doesn't fire Michelle Golden to give you her job and now you bash him constantly). Just like when you were a child, no one likes you...the only difference is if anyone were to subject you to the treatment today that you received as a child it'd probably be considered a crime. However, you sir deserve to have your tidy whiteys pulled over your head and a swirly! I'm sure you received many as a child and deserve plenty more, in my opinion...

If you can't take the heat, stop making up lies about others. What comes around comes around!

Black Spidey--snap out of it.  Personal attacks on this board make the one hurling them look immature and it makes your points look less important.  DVR you, are a double agent and frankly not trustworthy.  This is an unofrtunate result of an education gone bad--were you taught by Jesuits or Friars.
