Soooooooooooo Somebody........Can we also assume that you were in favor of the proposed Walmart Super Center on the triangle a few years ago? I mean after all....it was private property and the owners should be able to do whatever they want without any regard for the surrounding residents or the impact on the town in general........yes?

Again...just because something is in the town code doesn't mean it will hold up in court.  I don't know the particulars for race tracks in a town.  But if it's determined that limiting the use of such a race track is unconstitutional, it's for a higher court to decide.  Like I said...I don't know.

      I can tell you what is highly likely to hold up in court, an Article 78 law suit against the Town for intentionally failing to uphold ther own Codes when it has a negative impact on residents.  That's a slam dunk!

I am disappointed that the affected neighbors haven't already pursued an Article 78.  If the admin was going to do something, anything...it would have happened by now!
Why was this item pulled from the TB meeting agenda?  Why didn't MG acknowledge that an established racetrack was in existence?  Why doesn't the Town enforce their own Code?

Here is one reason that MG doesn't do anything about it....his personal truck has been seen there because his kid rides his ATV there all the time.....if the noise bothers call the Pd...all those dirtbikes and atv's need to be registered and insured unless delavilla owns them all! Can't ride them anyplace unless they are reg and ins. Accept if they are yours and on your property according to the vehicle and traffic law.

             Hey MT & Bumblethru, remember the old advice "Don't feed the troll!"  This person definitely has a reading comprehension disorder, and we really should not be picking on him/her as a result of that!  Also knows nothing about law.  They are correct about it being about noise, but that is the consequence of the racetrack operation!

Motorcycle racket irritates neighborhood
Town Board hears Fordham Ave. gripes over Della Villa land

    The jarring sound of revving engines usually begins echoing down the side streets off Fordham Avenue late Friday afternoon.
    Residents living in the otherwise quiet neighborhood report hearing the motorcycles and all-terrain vehicles for nearly eight hours a day throughout the weekend. They report seeing clusters of spectators congregating on Marc Della Villa’s property, where sometimes nearly a dozen bikes will take turns ripping around what even some town officials refer to as a racetrack.
    “It’s very clear its a racetrack and it’s very clear our [code enforcement] department should be enforcing it that way,” Town Board member Gerard Parisi said.
    But code enforcers haven’t cited Della Villa for illegally operating a racetrack, nor have they explained why a local ordinance more than four decades old wouldn’t apply to his property. As a result, some residents are wondering whether they have any recourse when it comes to quelling the noise that cuts through their neighborhood near the Schenectady city line on most weekends.
    “And it’s worse than it’s ever been before,” Fordham Avenue resident Ken Antalek told members of the Town Board Wednesday.
    Antalek and about a half-dozen irate residents pleaded for board members to take another look at the town’s racetrack ordinance and see if it could be enforced against Della Villa. Many of them were among the more than 50 residents that signed a petition urging the board to take action four months ago,
    Enacted in 1963, the law classifies a racetrack as any area where motorized vehicles are used in contests or demonstrations of skill for the entertainment of the public or the gratification of the contestants. The code stipulates that such racetracks require a permit and even lays out a schedule of penalties for any property owner operating one illegally.
    Supervisor Frank Del Gallo said the ordinance is too broad to be enforced. He said if Della Villa’s property is being used as a racetrack, then so are dozens of others throughout the town.

           Of course they're not going to enforce it, the racetrack owner and FDG are personal friends!

      At least ND and GP appeared to side with the residents, the others are "See No" "Hear No" "Speak No" Evil.

I would like for FDG to show everyone exactly where the other racetracks are located in rotterdam. Ones the size and magnitude of Westside's.  And I thought there were codes against this.......no?
