I will break my silence on this issue --- after reading the town code on race tracks and doing some of my own checking out of the matter --- it IS a racetrack If they want to continue to operate then they need to get the various approvals, provide proof of insurance, and pay for a permit to operate a race track. If the code enforcement person or inspector says it is not a racetrack -- then the Town Supervisor and/or Town Board should overrule that decision and say that it IS a racetrack.
What kind of checking out the matter. I have been riding my motorcycle on Mark's property many times. I have never seen any actual racing. I have see multiple persons riding at the same time, but I have never seen an actual racing event of any kind.
After reading most of the earlier posts it seems that the noise is the real issue with the neighbors. That is a cut and dried issue. If the noise exceeds the allowable levels at the restricted hours of noise, then the neighbors have a case.
I wish my neighbors did things differently, but unless they violate the law, I just have to live with it.
The Albany Saratoga Speedway issue comes to mind. It has been in operation since the 70s. The neighborhood has been built up around it and the neighbors try regularly to have the track shut down, using various loophole ordinances.
Mark's property has always been used industrially. The motorcycles are no louder than the bulldozers and other heavy equipment.
I was advised of proper hours of use and proper conduct while using the property and I have never seen anyone that did not follow the rules.
That is not racing. There is no start or finish lines, no track officials, no competition. If it is being used for racing events it should be easy to produce a video of actual races. People riding off-road vehicles on private property is not a racetrack.

I live 3 blocks to the north and at least one block to the west of this track and I can hear them clearly on any day they run there. I have NEVER heard a bulldozer or heavy truck coming from there, so I beg to differ on it being the same type of "noise" as that.

By your interpretation that would mean that no off-road vehicle could ever be used in Rotterdam. The definition of a race or contest is the determining factor.
Gratification of the contestants requires a race or contest to exist. Otherwise snowmobiling and trail riding would be banned from the entire town.

I have never heard dozers running from three blocks away. I can hear the bikes/Atv's it so well, I can tell whether its a two stroke or four stroke motor running. I didn't know the town statute until it was just posted...it's even more clear to me this, in the towns code, IS a racetrack. But, what do you care? You just ride your vehicles there and piss on the residents.

it seems like people just don't like motorcycles.....been that way for years...
This is not racing.....it is pleasure riding.....there are no contestants ....but a few people riding for enjoyment......have you ever been to a motorcycle race???

Understand.....the law in Rotterdam is not specific enough to say it is RACING......
Complain about the big trucks up and down all day long....polluting the environment.....about the cars racing past schools and not paying attention to signs''

Complain about the animals running loose and dangerous...
Then go to Town Hall and complain about the corruption in the REGIME,,,
