Residents living near Westside Avenue believe a 1963 law governing racetracks gives the town the right to end the sound of dirt bikes and all-terrain vehicles that echo from Marc Della Villa’s property on a recurring basis. They say a track constructed last year has led to a steadily increasing number of racers visiting the property each weekend to race. Last week, they submitted a petition to the Town Board with 53 signatures in an effort to bring an end to the races. Phillip Hurst, a homeowner on Dodge Street near the course, said the ordinance clearly gives Rotterdam the authority to cease the activity on Della Villa’s property and preserve their quality of life. “The noise is a factor for nearly everyone on that petition,” he said Tuesday. Enacted in August 1963, the law classifies a racetrack as any area where motorized vehicles are used in contests or demonstrations of skill for the entertainment of the public or the gratification of the contestants. The code stipulates that such racetracks require a permit and even lays out a schedule of penalties for any property owner operating one illegally. Hurst said Della Villa hauled truckloads of soil to the property all winter and has now expanded the course nearly to the railroad tracks at the southern edge of the parcel. He fears the warmer weather this spring will bring a procession of the vehicles to the neighborhood. “The frustrating thing about it is that we believe the town has the means to stop it, and we don’t know why they’re not,” he said. The racetrack ordinance outlines a permitting process, hours of operation and a mandatory level of liability insurance. The law also prohibits noise from traveling more than 500 feet from the racetrack in all directions. But town officials are not convinced that the property is being used for races. Is Marc Della Villa any relation to former Town Councilman Michael Della Villa?
These people have been complaining about this racetrack forever. Even during the last administration. They should just take pictures, if they can.

There is no question that the sound is clearly worse this spring. I have lived at the same address for 19 years and this the first year I have heard the dirt bikes/atvs from my house. Something has definitely changed.

I think there already is a law in place,right? It just needs to be enforced.

The town should legalize it, and then require him to pay for a multi-million dollar liability insurance policy and then bring DEC in and make him adhere to all environmental regulations.

ROTTERDAM - After repeatedly violating court orders to dispose of more than 70 cubic yards of solid waste, Marc Della Villa of Schenectady was recently sentenced to nine months in jail.
Della Villa, who operates a Schenectady County construction and demolition debris hauling business, was sentenced in Rotterdam Town Court for failing to properly dispose of a large pile of debris on his land, located at 2100 Westside Ave. in Rotterdam.
The illegal landfill has been at the location for more than a decade. In June 1994, the property was cited for 18 counts of illegal dumping. In July 1996, Della Villa's company.

That's the same Marc Della Villa. The same one referenced by Carolina Lazzari when she was on the TB as the James Gang. That was back when he and his business buddy Dennis Carringi were running an illegal C & D dump over there. Great comparison!
I doubt DEC would have regulations about ATV racetracks. At least I hope not. Don't look to big brother to solve all the town's problems.
This is a local issue and we already have noise ordinances on the books. Are all the ATV's licensed and registered? The cops can write tickets for that very easily. Is this a residential, commercial or business area?? Is it complying with the appropriate uses for that zoning?
I like riding my ATVs too, but I wouldn't want to run them in a neighborhood or have a racetrack near my house.
Michael Della villa's brother is named Sal. He loves in North Carolina.
And this has to do with what? And we're glad he 'loves' in North Carolina. Guess he couldn't 'love' in NYS....must be a new law!
