ALBANY, N.Y. (AP) - New York Attorney General Andrew Cuomo has recused himself in the investigation of whether Gov. David Paterson interfered with a domestic violence case involving a top aide.

Former Chief Judge Judith Kaye will also probe whether the governor lied about his intentions to pay for World Series tickets.

Absolutely, no doubt in my mind he should have.

HOWEVER (you knew that was coming, didn't you boomer?) .. look who he appointed -

      Hon. Judith S. Kaye, Chief Judge of the State of New York, was born in Monticello, New York, in 1938. She was appointed by Governor Mario M. Cuomo on February 22, 1993, confirmed by the State Senate on March 17, and sworn in on March 23, 1993.

She became the first woman to serve on New York State's highest court when Governor Cuomo appointed her Associate Judge of the Court of Appeals on September 12, 1983.



Now, about that non-prejudicial point of view?  Why choose this judge specifically?  Certainly there are others, as qualified?

I know NOTHING about this judge - at all, and no reason to believe she'd be prejudicial or favoring one point of view over another. She's very well known in legal circles, very versed in the law and highly regarded in her field, there is no question about that.

But why her?

I don't know why her in partiular unless it is because she is retired and able to do this in real time.  She came to speak at my daughters' school several years ago as a keynote speaker to a series the Albany Academy for Girls was kicking off in the name of a young graduate who had died.  (fell out a window at the college where she was studying)  I got to speak with her and have coffee with Judge Kay.  She was LOVELY.  Her talk was superb.  I remember though that her husband was quite ill at the time and I think he was dying.

You would have enjoyed her very much.  Bright--really bright and articulate, gracious and dignified.  You would have loved being in that audience because when she spoke she spoke directly to you despite the fact that you were Dem or Rep, Con or Lib.  It was a wonderful evening.  I think John Faso was there that night also.  His daughter Margaret was friends with my kids as well.  He also was well-liked and a good speaker.

Further: On March 17, 2008, she officially swore in David Paterson as the 55th governor of the State of New York.

Further, if Paterson steps down, Ravitch becomes governor and is able to appoint a Lt. Governor (as he is now):

Cuomo couldn't wait to hot potato this because his approval rating tanked 13% while he was "investigating".

     Judith Kaye is a great lady-but another hopeless liberal the type that has destroyed this State. If the REPS were smart they would run Steve Levy for Gov and move Lazio to Senate. Lazio can't beat Cuomo.
