Resolution 40-10 Legislator Dagostino (ECP2) A RESOLUTION AUTHORIZING SCHENECTADY COUNTY TO ENTER INTO A CONTRACT FOR THE PURCHASE AND SALE OF REAL ESTATE TO BE USED FOR BASEBALL FIELDS
RESOLUTION 40 -10 Sponsored by Legislator Dagostino: A RESOLUTION AUTHORIZING SCHENECTADY COUNTY TO ENTER INTO A CONTRACT FOR THE PURCHASE AND SALE OF REAL ESTATE TO BE USED FOR BASEBALL FIELDS BE IT ENACTED by the Legislature of the County of Schenectady, as follows: WHEREAS, the Commissioner of the Department of Economic Development and Planning by memorandum dated February 26, 2010 advises that the County has secured real property to be used by the Rotterdam Little League; and WHEREAS, the Commissioner of the Department of Economic Development and Planning further advises that the actual cost for the real estate is $260,000.00, and the property is located on Burdeck and Thompson Streets in the Town of Rotterdam (approximately 8.7 acres); and WHEREAS, the Commissioner of the Department of Economic Development and Planning further advises that the County would keep the property as parkland, and the Little League would lease the property and be responsible for the construction of the fields and the buildings; and WHEREAS, the County Attorney advises by memorandum dated February 26, 2010 that the seller is William M. Larned and Sons, Inc.; and R40-10 Page 2 WHEREAS, the County Attorney further advises that this contract has the following contingencies: (i) it must be approved by a majority of this Governing Body by March 15, 2010, (ii) the seller must receive a planned unit development approval, (iii) the County must lease or purchase a parcel for parking; and (iv) the County shall have obtained a permanent easement for an access road; and WHEREAS, the County Attorney further advises that the intended use of the property is as a County parkland, and that the County intends to allow the construction of various playing fields on such parcel to be used by the Rotterdam Little League; and WHEREAS, the County Manager by memorandum dated March 1, 2010 advises that this Governing Body consider approving the contract for the purchase of the aforesaid real property; now, therefore, be it RESOLVED, that this Governing Body authorizes the County Manager, after approval of the County Attorney as to form and content, to execute the aforesaid contract for the purchase and sale of real estate for a parcel of land in the Town of Rotterdam; and be it further RESOLVED, that the County Manager be and she hereby is authorized, after approval of the County Attorney as to form and content, to execute all other necessary documents for the purchase of the aforesaid real property from the seller identified in this Resolution. |
