Cops: Mothers signed pact to OK relationship between man and 13-year-old

The mother of a 19-year-old man and the mother of a 13-year-old girl thought they would avoid legal problems if they signed an agreement that allowed their children to have a romantic relationship, Schenectady police said.

German of Hulett Street is charged with second-degree rape and a host of other charges for allegedly having the relationship with the girl.
His mother, Tracy A. The 19-year-old man who has admitted to having sex with a 13-year-old girl — encounters that authorities say were with the blessing of both of their mothers — was released from jail Tuesday on the order of a judge. Schenectady County Court Judge Karen Drago ordered the release of Shawn M. German in the interests of justice because she said she believed the allegations against the mothers were just as serious or more so than the allegations against German. The mothers each face misdemeanor child endangerment charges that remain pending in front of another judge in City Court. German, 19, of Hulett Street, pleaded guilty in November to one count of second-degree attempted rape, a felony. German was offered 18 months in prison in return for the plea. But Drago said that she expected to sentence him later to time served, about six months. German was released just after noon, jail officials said. He has been in jail since his September arrest. “In the interests of justice, it would be a travesty to give him more time than these two adults,” Drago said. Drago also noted that German told probation officers for a pre-sentencing report that he has suffered from mental health issues since the age of 12. A 19-year-old Schenectady man, who had a note from his mother and the mother of his victim giving him permission to have sex with the underage girl, was sentenced to probation on Wednesday in Schenectady County Court. Shawn M. German’s mother and the mother of the victim, a 13-year-old, entered into a “contract” in which they blessed the expected relationship between German and the underage girl. Schenectady County Judge Karen Drago imposed probation for up to 10 years on German, who has mental health issues, and also made it clear she believed the mothers were really responsible. The two women were accused of entering into a written agreement to allow the relationship. “I truly believe the mothers should be subject to jail and/or prison time, not Mr. German,” Drago said. “He’s just a product of his environment.” The mothers were charged with misdemeanor endangering the welfare of a child. The girl’s mother pleaded guilty in February and received three years of probation and was assigned to perform community service, City Court records show. Her name is being withheld to protect the identity of the girl. Tracy A. Lisi, who is German’s mother, pleaded guilty in City Court Wednesday to endangering the welfare of a child. The sentence she is to receive was unavailable. But Lisi was present for her son’s sentencing Wednesday morning and the judge’s comments. Asked about them afterward, Lisi said she heard everything the judge said but indicated that the judge didn’t know everything about the case. She declined to comment further. German served approximately four months in jail. Drago ordered his release in February in the interest of justice, saying her belief then that the allegations against the mothers were just as serious or more serious. German, of Hulett Street, pleaded guilty in November to one count of second-degree attempted rape, a felony. He agreed on Wednesday to be listed as a Level 2 sex offender.
