Whether arson, terrorism suspect waived his right to attorney is key to case

SCHENECTADY -- The nearly two hour police interview last February of terrorism and arson suspect Steven Raucci could prove a key piece of evidence when his trial begins next month.


But jurors may never see or hear it because his attorney is seeking to get it thrown out on the grounds that Raucci never expressly waived his right to an attorney during the 75 minute DVD recording.
The prosecution, however, counters that the retired Schenectady school facilities director gave up that right both verbally and non verbally and wants the judge to allow the tape to be entered as evidence.

Both the defense and prosecution On Wednesday submitted written arguments to former Judge Michael Eidens who is serving as a judicial hearing officer in the pre-trial matter. He will ultimately issue a ruling based on those writings and the tapes which were played in court Jan. 13.

The prosecution contends that on Feb. 20 after Raucci was read his rights by Christopher Foster, a detective with the Rotterdam Police Department, he nodded his head when asked if he understood those rights. Prosecutors get OK to search camera found in Raucci’s office

    Prosecutors in the terrorism and arson case against Steven Raucci on Friday won the right to search a digital camera found in Raucci’s office.
    Prosecutors also began the process of turning grand jury transcripts of potential witnesses over to the defense, something that normally isn’t done until the trial itself is under way.
    The camera was recovered after the Feb. 20 search of the office at Mont Pleasant Middle School. The camera was housed in a briefcase seized from the scene.
    Assistant District Attorney Peter Willis made the request, submitting affidavits and papers to acting Schenectady County Court Judge Richard Giardino.
    Defense attorney Ronald DeAngelus opposed the warrant, citing similar arguments he unsuccessfully used to fight use of the briefcase itself.

Change of venue won’t be sought; trial starts March 1

The arson and terrorism trial of Steven Raucci will remain in Schenectady County, Raucci’s defense attorney said Tuesday.
Meanwhile, a judicial hearing officer ruled Tuesday that the video of Raucci’s interrogation by police would be allowed at the trial, though Schenectady County District Attorney Robert Carney reiterated he remains unsure whether he will use the recording.
    Raucci’s attorney Ronald DeAngelus confirmed Tuesday that Raucci would not seek to have the trial moved to a different county. A potential change of venue request by the defense had been the topic of speculation, given the intense pre-trial interest in the case.
    But DeAngelus said Tuesday his client wants the case to remain in Schenectady. Trial is set to begin March 1.
    “My client has great respect for the people in Schenectady County,” DeAngelus said.
    The case has garnered extensive pre-trial media coverage, helped along by a protracted bail fight, lawsuits, attempted lawsuits and open questions related to whether anyone at the city school district knew of Raucci’s alleged deeds. Carney has alleged that higher-ups at the district were beholden to Raucci.

SCHENECTADY -- Embattled Schenectady schools Superintendent Eric Ely is a finalist for a job in Erie, Pa., a person familiar with the district's hunt for a new leader confirmed this morning.

Ely is one of three finalists for the superintendent's position and will soon travel to northwestern Pennsylvania to participate in a public forum in the next two weeks, according to multiple sources with knowledge of the Erie search, said the official, who spoke on condition of anonymity. A local official also confirmed that Ely is a candidate for the post.

The Erie district is holding community forums to introduce the candidates.

Ely could not be reached today.

When contacted Wednesday night, Ely declined to say whether he was a candidate for the Erie job.

"If and when they choose their finalists and if I'm one of the finalists, then I'll talk about it," Ely said.

Schenectady school chief selling house

SCHENECTADY -- The embattled city schools superintendent has placed his house on the market -- he says to find a residence that's more manageable.

Eric Ely's Oakland Avenue home is for sale. He said he wants to find a smaller house.
Ely recently said he has received no job offers, but he would not confirm or deny if he's actively looking for another position. He would only say that he wouldn't turn down an opportunity if it would benefit his family.

School superintendent in running for Pa. job

    Schenectady School Superintendent Eric Ely is one of three finalists for the superintendent of schools job in Erie, Pa.
    Ely is vying to replace Jim Barker in the 13,000-student district, according to an Erie School District official who did not want to be identified.
    The other two candidates are Erie Assistant School Superintendent Jay Badams and Thomas Washington, assistant superintendent for human resources in Bethlehem, Pa., the source said.
    The Erie Times-News reported the three candidates’ names on its Web site on Thursday.
    Ely, 50, declined comment because Erie has not released the names of the finalists.
    “I would prefer not to discuss it at all. They have a process in place, like every school district does, and I will respect their process,” he said. “I’m not going to comment on rumors and leaks.”
    A formal announcement of the candidates is expected today or Monday. The Erie district is holding three community forums on Feb. 18, Feb. 22 and Feb. 23 to allow people to meet the finalists.
    The salary range for the position is between $160,000 and $175,000. Ely made $193,899 in 2008-09 in his current position.
