Rotterdam man accused of running down boy while drunk November 5, 2008 Updated 10:31 a.m.
ROTTERDAM — A local man faces two felony charges after police said his vehicle struck and seriously injured a young boy attempting to cross Curry Road early Tuesday evening.
Gabriel Gomez, 36, of Curry Road, was charged with felony counts of first-degree vehicular assault and aggravated unlicensed operation of a motor vehicle, in addition to a misdemeanor count of driving while intoxicated. He was arraigned in Town Court and sent to the Schenectady County Jail without bail.
Lt. Jason Murphy said Gomez was driving east around 5:15 p.m. when he struck a 12-year-old boy trying to cross Curry Road near Memorial Park at the Sunrise Boulevard intersection. The boy, who investigators declined to identify, was taken to Ellis Hospital with a head injury.
“He was seriously injured,” Murphy said.
Murphy this morning could offer no update on the boy’s condition.
Gomez was also living on Curry Road in 1994 when he broke into a Rensselaer Avenue home, fleeing after the homeowner returned.
Gomez was sentenced to 90 days in jail after admitting to third-degree burglary, but state proson records indicate that he served a 16-month to 4-year sentence.

A Rotterdam man indicted on felony charges after he allegedly struck a boy while driving drunk last year is now facing a civil lawsuit. Gabriel Gomez is named as defendant in a lawsuit brought by the family of the injured boy. The lawsuit was filed earlier this month in state Supreme Court in Schenectady County, seeking damages related to the Nov. 4, 2008, accident on Curry Road in Rotterdam. Gomez, 37, of Curry Road, was indicted Sept. 10 on two counts of first-degree vehicular assault and misdemeanor driving while intoxicated, as well as one count of first-degree aggravated unlicensed operation. Gomez is accused of striking the 13-year-old boy, identified as Austin D. Kownack, while driving east on Curry Road just after 5 p.m. that day. Drunken driver who hit boy sentenced SCHENECTADY — A local man accused in 2008 of driving drunk and hitting a child was sentenced Friday to six months in jail. Gabriel Gomez, 37, who then resided on Curry Road, had pleaded guilty earlier to first-degree aggravated unlicensed operation, a felony, and misdemeanor-level driving while intoxicated.Gomez was accused of striking the 13-year-old boy while driving east on Curry Road just after 5 p.m. Nov. 4, 2008. The boy was crossing Curry Road near Memorial Park at the Sunrise Boulevard intersection when he was struck. The injuries to the boy were nonlife threatening. For that reason Gomez got a lighter sentence than he could have, offi cials said.The boy’s family filed suit against Gomez last year. Gomez was sentenced to six months in jail and five years’ probation. Gomez apologized in court. “I don’t think there’s any doubt you’re remorseful for what happened,” Schenectady County Court Judge Karen Drago told Gomez. “You certainly didn’t intend for it to happen, but you have to take responsibility for it.” Gomez nodded in agreement. Prosecuting the case was Michael Tiffany, defending it was Gerard Amedio.
