Maybe. But from what I am told, the water was shut off to that home a few years ago due to a main water leak. So the home has no running water. I was also told by neighbors that he does come by weekly, by taxi cab, to pick up his mail.

Like I said in a previous post, if the home remains vacant, it needs to be cleaned out, kept up and secured.

It looks like my google street view link was the WRONG house ... damn, I hate when I do that

The front door was even "ajar" at that point, and it's believed to be July/Aug 07 that those pictures were taken by their roving camera rentacars.

I honestly never even SAW that house - or if I did, I assumed it was a garage or shed - it's so TINY!

One of the neighbors told me that the door to this house has been nailed shut. I don't know if it was done by the town or by the owner.

my mom lives next door to this crap for the last 4 years we have been trying to get something done but they say as long as taxes are being paid nothing can be done.
the man who lives here lives at the stardust hotel he was served with a sitation to clean up 3 months ago and to keep the grass mowed but since the sitation nothing has been touched
i have been in contact with family member and they don'twant anything to do with it.
time to clean up and tear down and send this man the bill.
peple in the neighborhood are tired of this eyesoar time to take action now

I don't think that anyone is without compassion for anyone who is, as you type it, 'me_tal or something'. I heard people in the neighborhood say how a smell comes from the house when it is humid out. Are you suggesting that the rest of the 'tax payers' have to just put up with this? How about some compassion for them as well? The pictures here show what the inside looks like. It looks like one big wooden garbage can.

And if this person owns this house and is able to get a mortgage, pay his bills/taxes and yet can afford to pay and live in a motel....he clearly is not that 'me_tal'. In fact this person is doing pretty well, wouldn't you say?

I say the health dept should be called next if any more rats are seen.

Someone told me that there is a Rotterdam elected official who has a relative across from this house. Now I find that hard to believe. If an elected official has a relative across from this house, they would surely have done something about it within these past 4 years.

§ 265-4. Duty to maintain property.

No person owning, leasing, renting, occupying, being in possession of, or having charge of any property in the Town, including vacant lots, shall maintain or allow to be maintained on such property, except as may be permitted by any other Town ordinance, any of the following conditions:
A.     Junk, trash, litter, boxes, discarded lumber, salvage materials, or other similar materials in any front yard, side yard, rear yard or vacant lot;
B.     Attractive nuisances dangerous to children, including, but not limited to, abandoned, broken or neglected equipment, machinery, refrigerators and freezers, excavations, wells or shafts;
C.     Broken or discarded furniture, household equipment and furnishings in any front yard, side yard, rear yard or vacant lot;
D.     Shopping carts in any front yard, side yard, rear yard or vacant lot of any property;
E.     Graffiti or signs, not in compliance with the Town Zoning Code, Editor's Note: See Ch. 270, Zoning. on the exterior of any building, fence or other structure in any front yard, side yard or rear yard or vacant lot;
F.     Vehicle component parts or other articles of personal property which are discarded or left in a state of partial construction or repair in any front yard, side yard, rear yard or vacant lot;
G.     Any accumulation of weeds, brambles, berry vines, or other vegetation which is over-growing any structure or which exceeds an average height of 10 inches, except that which is kept in a neat and orderly manner for human consumption, or any accumulation of dead organic matter, offal, rat harborages, stagnant water, combustible materials and similar materials or conditions constituting fire, health or safety hazards; however, this does not apply to cultivated flowers or gardens. Properties in A-1 are excluded from this requirement; however, they must conform to all other pertinent sections of the Town Code.
H.     Dilapidation or state of filthiness or uncleanness of any dwelling or other structure which endangers health or life or which permits entrance by rats, mice or other rodents, or by which conditions it attracts rats and other vermin.
I.     The active selling of motor vehicles in a residential zone is limited to two motor vehicles within a given calendar year.
J.     No outside storage of more than two unregistered motor vehicles on any property. Vehicles are to be stored behind the house in the rear of the property with a five-foot side and rear setback.
§ 265-5. Residential buildings and structures.

A.     Exterior walls, roofs and porches or appurtenances thereto shall be maintained in a manner so as to prevent the collapse of the same or injury to the occupants of the building or to the public.
B.     The foundation walls of every building shall be maintained in good repair and shall be structurally sound.
C.     Exterior walls, roofs and other parts of buildings shall be free from loose and unsecured objects and material and improperly secured objects and materials. Such objects or materials shall be removed, repaired or replaced.
D.     The owner of vacated buildings shall take such steps and perform such acts as may be required from time to time to ensure that the building and its adjoining yards remain safe and secure and do not present a hazard to adjoining property or to the public. All openings shall be covered with painted. exterior-grade plywood closures and securely fastened to prevent trespassing. See Chapter 93. Editor's Note: Chapter 93, Vacant Buildings, was deleted at time of adoption of Code (see Ch. 1, General Provisions, Art. I). See now Ch. 90, Unsafe Buildings.
E.     Buildings and structures shall be maintained in such a condition that they shall not become unoccupied hazards as defined per Chapter 90 of the Code of the Town of Rotterdam. All graffiti or defacing shall be removed and the surface finish restored within five days' written notice of the Building Inspector/Code Enforcement Officer.
F.     All signage and lighting systems shall be maintained in a completely operable, clean and safe condition.
G.     All swimming pools shall be maintained and operated in a clean, safe and sanitary manner at all times and in compliance with the New York State Uniform Fire Prevention and Building Code. Swimming pool recirculation and disinfection equipment shall be operated to maintain water quality. Swimming pool equipment and appurtenances shall be operated and maintained in accordance with approved plans and specifications. Editor's Note: See also Ch. 252, Swimming Pools.
H.     All decorative pools, fountains, architectural garden features, and similar items shall be maintained free of litter and operated as intended. Should these devices be abandoned or should they deteriorate because of lack of adequate maintenance, the owner shall either repair, remove or replace these items within five days of written notice.
I.     Grass lawns on any lot improved with structures shall be maintained free of unrestrained growth and in compliance with the New York State Uniform Fire Prevention and Building Code. Nothing in this chapter shall be construed to prohibit gardens, woods, generally recognized groundcovers and lawn grasses, or properly maintained compost piles.
J.     Placement of animal feed on the premises for the purposes of feeding nondomesticated animals shall be carried out in a manner that avoids a noxious impact on the premises or the neighborhood and that avoids detriment to public health or safety.
K.     The maintenance of fences on properties shall be the responsibility of the owner of the fence.

Town set to fight yard debris
Cleanup laws will be enforced

    Robert Adams is fed up with the condition of the property next door.
    The Guilderland Avenue resident said he’s complained to the town about the condition of the small teal bungalow for nearly two years. Rubbish is piled fi ve feet high in the garage, and there are two unregistered cars parked in the driveway.
    During the summer, he said, the home’s above-ground pool becomes filed with algae, and accumulating garbage draws flies by the hundreds. The condition of the home has deteriorated to the point that even his young grandson has taken note of it.
    “It’s getting worse and worse,” Adams said Monday.
    Town officials said they’ve visited the property on numerous occasions. But the visits haven’t changed anything, and Adams is frustrated.
    “I can’t throw my hands up and quit pursuing it,” he said. “But how long is this going to go on?”
    Supervisor Steve Tommasone said he’s aiming for less than two months. He said the Department of Public Works is compiling information on properties that have historically had code enforcement issues, with the intention of the town addressing the entire group at once, rather than piecemeal.
    “We’re going to approach them wholesale,” he said. “We will be moving on all of them at once.”
    Tommasone said there are about two dozen properties in the town — including the one on Guilderland Avenue — that are persistently at odds with Rotterdam’s property maintenance laws.
    He said the town will host a public hearing about the properties and then seek to legally compel all of them to be brought into compliance.
    Town officials have experienced difficulties in getting some persistently obstinate landowners to conform with Rotterdam’s codes.
    The most publicized of these battles occurred between the town and Pattersonville property owner Michael Marotta.
    Rotterdam’s code enforcement department first cited Marotta for running an illegal junk yard in 2005.
    Marotta pleaded guilty to the violation but never cleared the property to the town’s satisfaction.
    County officials ultimately paid more than $15,000 for a cleanup and are still trying to recoup their expenditures from Marotta, who continues to store unregistered vehicles on the property off Route 5S.
    Town officials cited him again last year, and he again promised to remove the vehicles.

I hope that the Beverly Street house is still being considered. The neighbors say that the inside is still filled with garbage. They can hardly wait for the hot humid days.
