ROTTERDAM Apartments need zone change, board rules BY JUSTIN MASON Gazette Reporter
The Zoning Board of Appeals ruled the owners of the Rotterdam Housing Area cannot continue to lease apartments on the property without first applying to for a zone change. Members of the board unanimously passed a resolution Wednesday stating the military’s residential use of the property did not carry over when Sync Realty purchased it at auction from the U.S. General Services Administration last year. They determined the federal government used the eightacre complex off Route 7 exclusively for housing military personnel and civilian contractors, meaning the public was never able to lease space when the property was being used for residential purposes. “The federal government used the property exclusively —that is to the exclusion of the public,” the resolution states. “The activity of a commercial entity renting out to the public is totally dissimilar.” The property is technically in an area of town zoned for light industry. But federally-owned properties are not subject to local law, meaning the 57-year-old housing area never had to conform to the town’s zoning maps. Representatives from Sync had argued the complex was constructed before the town implemented its zoning code and should therefore be allowed to continue using it for residential purposes. They claimed the property was an example of a “pre-existing, non-conforming use.” Sync can now either apply for a zoning change on the property or can fight the board’s ruling in Schenectady County Supreme Court. Representatives from the Philadelphia-based property development company were not at the meeting Wednesday, and attempts to contact their attorney were unsuccessful. In November, an attorney representing the company suggested they would file a lawsuit against the town if they were not granted their appeal. At the time, he said the company might consider applying for a zoning change, but such a move would leave them with little legal recourse if the town decided not to grant it. Town Attorney Gerard Parisi said Rotterdam officials met with representatives from Sync this winter to discuss resolving the matter. He said the town is demanding a number of concessions —including several major improvements to the property —before considering the zoning change. Sync purchased the property for $1.92 million after submitting a winning bid on the land in February 2008. The company began leasing apartments in the six multi-family buildings on the property about fi ve months later and without seeking a zoning change or a certificate of occupancy from the town. Sync Realty will need to link the former Rotterdam Housing Area into the town’s sewer line or evict tenants now living in the complex of apartments, according to a ruling handed down in Schenectady County Supreme Court. Judge Vincent Reilly Jr. denied a preliminary injunction filed by the Philadelphia-based property development company that would have allowed them to continue using a line running through the Rotterdam Corporate Park. In his January ruling, Reilly gave Sync four months to find a new arrangement or face losing sewer service for the property, which has six apartment buildings, a two-story duplex townhouse and a single-family ranch-style residence. David Lenney, an attorney for Sync, said the company has already filed an appeal. He said arguments in the case will likely be heard in early spring, with a decision coming two months later. Meanwhile, he said, Sync is negotiating a temporary arrangement with Rotterdam Ventures, a subsidiary of the Galesi Group, which owns the corporate park. Galesi can shut off sewer service to the eight-acre property starting in mid-May, according to the court decision. Court documents filed in the case indicate an ongoing feud between Rotterdam Ventures and Sync, which began shortly before Sync purchased the Rotterdam Housing Area property at auction from the U.S. General Services Administration last year. Sync argued that the deed to the property stipulated that the owners of the corporate park would provide sanitary services at a “mutually agreeable” rate. Tong Cheng Zhang, an associate with Sync, claimed that Rotterdam Ventures wanted to buy the property cheaply from the government and became angered when his company secured the winning bid. He claimed that the “threat” to terminate sanitary service was retribution for Sync’s acquisition of the property. “[Rotterdam Ventures]’ motive for this threat is apparently revenge,” he said in court documents. “[Rotterdam Ventures] had representatives at the open house for the sale of the property, including [Galesi Chief Operating Officer Dave Buicko], who made many negative and untrue statements about the property and its condition with the intent of scaring away other bidders.” Buicko disputed this characterization, according to court documents. He said that Sync was given ample warning that the corporate park would terminate the sewer agreement once the government sold the property but decided to move in nearly three dozen tenants anyway. “What I did relay is the fact that Rotterdam Ventures is a growing company and that because of the hundreds of large and small tenants presently in its park, it needs this additional sewage capacity to service its clients and grow,” he said in court documents. Dozens of renters and families face an uncertain future at the former Rotterdam Housing Area following a state Supreme Court decision that upholds the Galesi Group’s right to shut off the property’s sanitary sewer connection. The Appellate Division affirmed a lower court ruling denying an injunction property owner Sync Realty had sought to prevent Galesi from cutting off the housing area’s sewer service. Absent further legal action, the Philadelphia-based property development company will need to find a new sewer connection, work out a deal to lease Galesi’s line or face evicting the roughly 100 people now inhabiting the Duanesburg Road complex where former President Jimmy Carter resided during the 1950s. David Buicko, Galesi’s chief operating officer, was unsure how his company will proceed in the wake of the ruling. The deadline for Sync to fi nd a new sewer arrangement passed more than a month ago. “We haven’t crossed that bridge yet,” he said Thursday when asked if Galesi would shut off the sewer service. “It’s unfortunate they didn’t heed the advice of the government when they told them to make their own arrangements.” Buicko said Galesi has footed the bill for Sync’s sewer service since June. In that time, he said, the company has received nearly $20,000 worth of service they haven’t paid for. An attorney representing Sync in the action declined to comment on the ruling Thursday. Actually, I wonder how this is the case, considering the tax bill this year was actually higher from the county than it was from the town. So, in the end, it Suzie (the) Savage and her Dem cronies at the county level who are charging too much taxes for the person to be able to pay for new sewers to be put in, or for a new agreement to be reached to work with Galesi.
