The way that our state handles this rebate is that we're getting money back from taxes that we overpaid and already paid taxes on so we can claim it on next years tax bill and pay taxes on that money again. What's wrong with this picture?

This should not be legal. If I have to pay taxes on it again, then they should just keep it.

Senior citizens eligible for the enhanced STAR tax relief program have begun getting rebate checks in the mail from the state Department of Taxation and Finance. Thomas Bergin, spokesman for the department, said the rebate checks and application notifications have been going out as scheduled. The schedules are available on the Web sites of the Department of Taxation and Finance and the state Office of Real Property Services. They show that most homeowners aged 65 and older in the Capital Region should have received a check by now. Mailings to Schenectady and Albany county seniors were supposed to have been done by Sept. 4, and in Saratoga, Schoharie, Montgomery and Fulton counties, checks should have been out by Aug. 31. However, seniors in the Saratoga County city of Mechanicville have not gotten their checks yet. Bergin said that’s because Mechanicville has a later annual deadline for fi ling its updated tax roll with the ORPS. Those checks should be mailed by the end of next week, he said. Enhanced STAR recipients get their checks automatically, without the need to apply, because their incomes are already on record with the state, according to ORPS spokesman Joseph Hesch. Homeowners in the regular STAR program — younger than 65 — also are eligible for rebates but must apply by Nov. 30. The state is scheduled to send out application forms to Capital Region residents starting Monday. The STAR program provides state-subsidized school tax reductions by reducing assessments. The rebate program, which was adopted in this year’s state budget at a cost of $1.3 billion, provides checks to homeowners on a sliding scale based on income and local tax rates. The maximum benefit upstate goes to households with income of less than $90,000, which in the city of Schenectady will translate to a $513.58 check. That’s more than the supposedly “enhanced” STAR rebate amount of $405.06. The maximum income cutoff for the program is $250,000. Senate Majority Leader Joseph Bruno, R-Brunswick, has advocated passing new legislation to increase this year’s enhanced STAR rebates for seniors by $200 million to make up for money cut during budget negotiations, and Gov. Eliot Spitzer has indicated that he is open to the idea. If that were to happen, the Department of Taxation and Finance would have to send out another round of checks. However, the proposal is tied to unresolved issues, and it is unclear when the Legislature may go back into session. The relationship between Spitzer, a Democrat, and Bruno has markedly deteriorated since the end of the regular legislative session in June.
