Someone asked me a very interesting question today. They know that there are folks that do not approve of the Kosiur sex offender law. But they asked 'what are the reps going to do instead?' I clearly had no answer!
They used the senerio of how the dems are against the war in Iraq but have no clear cut plan to stop it. So does anyone have that answer?

If the sex offenders are in fact a threat to our children then keep them in jail until they're not or turn them into a gelding and then let them out of jail.

This used to be done....not specifically for 'sex offenders' but for the mentally challenged......the women would be sterilized.....back then there were no sex offenders---it was okay for a 30 or 40 year old man to marry a 13-18 year old girl/woman......it was the pleasure of the father to 'give her hand away'.......sooooo, it must be animal instinct.....or breed into us......it is always about infatuation with youth and self gratification.......just look at Hugh and Larry......

      Nor will I trouble to rebut Ms. Savage’s assertion that the county Legislature did all kinds of research before passing the law, since that is patently false. There is no study that anyone has ever produced that shows any relationship between residency laws and actual sex offenses.


We will soon know the truth regarding the extent of the research that the county legislature conducted prior to the passage of the law.  I have submitted a Freedom of Information Law request for all pertinent documents.  By law, the county has 5 days to respond to my request.

It is important to realize that the grassroots effort to force the Schenectady County Legislature to rescind or to revise this law so as to protect ALL of the families of the county must persist beyond the July 31st special election for the 105th District seat in the NY State Assembly. Though the passage and the timing of the law was a calculated ploy by Mr. Kosiur to pander to voters, the potentially adverse impact of this flawed legislation transcends political party affiliation. The public must express their disapproval and contempt for those sheepish county legislators who supported Kosiur’s proposed law that was rushed through without due diligence being done and without public comment being solicited.

The following are the names and political party affiliations of those Schenectady County Legislators who voted FOR the passage of Local Laws 03-07 and 04-07 that establish residency restrictions for convicted sex offenders. Several of the supporters of the law are running for reelection in November. It is important to remember that Mr. Kosiur did NOT act alone in passage of this ill-advised and flawed legislation. DISTRICT 1: Michael Petta (D), Vincent M. DeCerbo (D), DISTRICT 2: Gary Hughes (D), Edward J. Kosiur (D), Philip Fields (D), DISTRICT 3: Robert T. Farley (R), Dr. Brian Gordon (D), Susan E. Savage (D), DISTRICT 4: Judith Dagostino (D), Joseph J. Suhrada (R), Anthony Jasenski, Sr. (D). My appreciation to the following Legislators who voted AGAINST the legislation: DISTRICT 1: Karen B. AND.......it is only those that are caught...the first time, the second time, the third time,the fourth time etc.......now they will say 3rd time offense or some rediculous statement....okay so there are 1000 new caught charge convicted offenders,,,lets just say 75% or 750 of them recommit a sex crime(I dont care what level--that is just stupid talk, no one can get into their heads no matter what the zoloft/paxil/adderall folks say) that number is now 1750, out of the 750recommitters, 50% of them recommit a sex crime the number has now increased to 2125.........Do we wait that long for the law to 'bite'?

Everyone is afraid to make a line for the 'bite'.....no one can classify a sex offender/sex predator/pervert or whatever the terminology is......it would probably also have to include the porn industry(even if it is legal).....this would include movies/books/magazines/stores/clubs etc........let me just say this......

Offender law unenforceable, so why bother?

   As if it weren’t already obvious that Schenectady County’s tough new law requiring sex offenders to move if they live within 2,000 feet a day care center, school, park or other place dren congregate is fundamentally flawed, a story in last Wednesday’s Gazette made quite clear that it’s going to be an enforcement nightmare.
   First, the law will have to withstand a legal test each and every time an eviction is pursued: County officials say they won’t be able to obtain one without a court order.
   Then sheriff’s deputies will have to figure out how to evict the sex offender without disturbing any other members of his or her family. (It arguable, of course, how good it is for a family be split up in that fashion.)
   Then if the deputies change the locks — which is standard eviction procedure — they can’t those other family members keys. They also can prohibit the sex offender from returning for a visit, but it would hard to tell whether he or she was just visiting or planning to re-inhabit. Officers would have to stay overnight themselves monitor the activity.
   Are county officials crazy enough to go through all this simply to ensure that even a one time, minor-league sex offender, who may have been lawfully living in the community for several years after his or her release from prison, simply can’t sleep anywhere near a school, day care or park — when it’s acceptable for such a person still visit such places? In fact, this law will make the public no safer than the status quo. And what’s the point, considering that the recidivism rate for sex offenders is relatively low, much lower than for most other criminals?
   It’s not uncommon for lawmakers to pass laws like these just so they can say they’ve “done something” about a problem — even when they know they haven’t, or that the law will be unenforceable. We suspect that was the case here, as the law’s sponsor is now bragging about it in his campaign for Assembly. And we certainly hope they don’t try to enforce it, because even if they did succeed, it would be at considerable cost to the taxpayer and wouldn’t necessarily provide any better protection against determined sex offenders.

Mr. Kosiur has stated that he hopes that many of the sex offenders who currently reside in the exclusions areas will voluntarily relocate, most likely outside of the county.  While I suspect that there may be a few who will leave, the number will be very small as the constitutionality of the law is debated and challenged in court.  There will be limited enforcement of the "Kosiur's Law" initially so that those who voted for the legislation in the Schenectady County Legislature and, indeed, Kosiur himself, can claim that the new law is making a difference, thereby saving face.  An eviction, shortly after the effective date of October 1st, of one of the sex offenders who reside in an exclusion area (most likely located in the Village of Scotia or City of Schenectady) will be executed employing all of the city and county resources available and necessary and at a considerable expense to the taxpayers.  This public eviction will be  publicized by the media and hailed as an undisputable win for the residents of the county.  I project that the issue and those sex offenders who reside in the exclusion areas will largely be forgotten after the November elections for the Schenectady County Legislature.  Legal challenges, brought by those who are displaced from their homes, of the constitutionality of the law and the considerable court ordered financial awards for damages will be all that will remain for the residents of the county.
