The owners of the plaza have been notoriously known to not 'keep up' their property...both inside and out. I hope that if they keep it and decide to re-rent out their spaces...they will update and keep up on their maintance of that structure. As much of an eye sore that it is now...if updated, it could be a plus to Rotterdam.

ROTTERDAM Businesses sue owner of retail plaza Fees allegedly owed for moving from spaces early BY JUSTIN MASON Gazette Reporter
Some of the former tenants from Rotterdam’s Capitol Plaza are suing the property’s owner, claiming they are owed hundreds of thousands of dollars for leaving the defunct shopping center years before their leases expired. The owners of I Love New York Pizza and The Newest Lunch filed suit against Capitol Plaza owner IJM Associates Inc. in Schenectady County Supreme Court, alleging that the company failed to pay them a fee they were promised in accordance with the terms of their lease. In response to the suit, an attorney from IJM filed a legal action in January that names HDB Rotterdam LLC, the company trying to buy the property to build a Walgreens Pharmacy, claiming that they are responsible for not completing the terms of the deal. I Love New York Pizza owners Mrija Shkreli and Leke Celaj are seeking $200,000 that was stipulated as payment for terminating their lease early, according to court documents. The restaurant owners renewed their lease for five years in August 2003 but agreed to leave with more than a year remaining in the agreement after it appeared that HDB had reached a deal to buy the shopping center in December 2007. Similarly, Newest Lunch owner Athanasios “Tommy” Plakas is seeking about the same amount after receiving only $50,000 of the $250,000 termination fee he was promised. Both business owners are also seeking a return of their security deposits and any other compensation deemed justifi able by the court, according to the suit filed in August 2008. “It’s unfortunate that these tenants had to stop valuable businesses and then the sale of the property doesn’t go through,” said Louis Chicarelli, an attorney representing both of the restaurateurs. “It’s not like they can go back there and start up again.” IJM is seeking to be indemnifi ed against the former tenants’ claims and accuses HDB of fraudulently delaying the sale of the property. The company is also demanding that HDB transfer the rights to a small property near Capitol Plaza and another located in an upscale South Carolina development promised to IJM if the deal for the shopping center fell through. “HDB has without justification failed or refused to perform under the terms of the [purchase and sale agreement] and its amendments in breach of contract with IJM,” company attorney Douglas Rose stated in the lawsuit. An attempt to reach Bob Blank, a principal of HDB, was unsuccessful Tuesday. Last month, Blank said the deal to purchase Capitol Plaza would go through and its demolition would be forthcoming. In 2005, developers proposed demolishing Capitol Plaza at the intersection of Curry Road and Altamont Avenue to make way for a pharmacy. Following its approval in 2006, the project faced numerous setbacks, including a lengthy relocation of the plaza’s 14 business tenants and the acquisition of a sliver of state Department of Transportation land adjacent to the plaza. The legal wrangling started shortly after a representative from Walgreens told members of the news media that the company had pulled plans for a store at the intersection where Capitol Plaza has stood for more than five decades. Blank later claimed that the company’s diminished interest in the site was a misunderstanding and insisted that the plaza would soon be demolished. Sounds like some real crookery. I heard from another tenant that is not mentioned that the same happened to him, and sadly he has passed on now and will not be able to use the money he was cheated of. I hope there is a hot place in hell for such cheats.
