Was it a case of "enough is enough?" If so, State Police say this wasn't the way to handle it.
More information is coming out about that armed incident in Duanesburg earlier this week in which two trucks were found torched along a rural road. Troop G Capt. Robert Patinude says Ralph Olson and Kenneth Montgomery evidently had had it with their neighbor dumping garbage in the area, and armed with assault weapons, went to confront him twice on Monday night.
They threatened to shoot him if he didn't stop, and left. But later, Patinude says, they came back, and again threatened to kill him if he didn't stop dumping. But this time, they also made him lay on the ground, and fired shots above his head. Then they poured gasoline over both trucks and set both on fire and left the scene.
Patinude doesn't think Olson and Montgomery were trying to kill the unidentified neighbor, but rather, simply trying to scare him. Both men are facing numerous charges, including arson, assault, and weapons charges.
DEC has fined the victim on several occasions dating back to 2003, and police say the agency has been made aware of this latest incident.

On June 30, 2016, the State Police in Princetown arrested two individuals in conjunction with the arson investigation of two vehicles which were purposefully torched on Mariaville Scotch Churches Rd (ST-160) in the T/Duanesburg on June 27, 2016.
Arrested for their involvement in the incident was Ralph P. Olson, 46, from the Town of Florida and Kenneth W. Montgomery, 38, from the Town of Duanesburg.
It is alleged that on June 27th, Olson and Montgomery entered the property of the victim on two separate occasions. On each occasion, Olson and Montgomery were armed with assault weapons and the victim was threatened with death at gunpoint. On the second occasion, one of the suspects fired his weapon in close proximity to the victim's head and then ordered him to lay prone on the ground at gunpoint while the other suspect poured fuel onto both trucks prior to igniting them. Both vehicles were a total loss.
The initial investigation consisted of State Police examining the scene and collecting physical evidence, along with contacting the Schenectady County Fire Coordinator's Office to assist and make a determination of the cause and origin of the fires. Numerous interviews were also conducted which ultimately led to the identification of two suspects and the physical evidence which was gathered at the scene was consistent with the facts reported by the victim.
Search warrants were executed at both subject's residences and additional evidence was secured; two AR-15 style assault weapons as well as four illegal handguns were also recovered.
Olson and Montgomery were each charged with 2 counts Arson in the third degree (Felony), Menacing in the second degree (Misdemeanor), Reckless Endangerment in the first degree (Felony) and Criminal possession of a weapon in the fourth degree (Misdemeanor). Additional charges are pending.
They were arraigned in the Town of Duanesburg Court and remanded into the custody of the Schenectady County Sheriff with no bail.
In addition to the investigating Troopers and BCI from Princetown, the Schenectady County Sheriff's Office, the Montgomery County Sheriff's Office, State Police patrols from Fonda, Cobleskill, and the Thruway, and the State Police Special Operations Response Team responded when initial reports of an active shooter were received.
Officials involved in the investigation will be available for comment and interview at the Troop G Headquarters building at 10:00 AM today. Troop G Headquarters is located at 760 Troy Schenectady Road, Latham, NY 12110.
