SCHENECTADY — A woman was hit by a car late Tuesday as she crossed State Street, city police said Tuesday.
Lt. Mark McCracken, police spokesman, said the unidentified 57-year-old woman was crossing south about 11:45 p.m. near the intersection with Moyston Street when she was hit.
The Schenectady Fire Department treated her at the scene. She was taken to Albany Medical Center with head and leg injuries that were not considered life-threatening, police said.
The pedestrian was in error and could potentially be ticketed, McCracken said. The driver was not ticketed.
State Police assisted in the investigation.

It says ' The pedestrian was in error and could potentially be ticketed '

So I wonder where the law can go with this ?  Any damage to the car ?  should the jaywalker pay ?
What about emotional stress to the driver- thinking he may have killed somone and now has nightmares and needs to see a psychiatrist  once a week

and  then what about someone jaywalking and gets hit by a drunk driver ? whos fault is that ?

we avoid Schenectady at all costs UNLESS we HAVE to go there or thru there.

on every occasion there are folks always crossing the streets.....where ever and when ever.

folks on bikes.....folks with baby strollers....kids, adults......

honestly, i'm really surprised that this doesn't happen more often.

That would be a civil matter in the courts and most likely the damage to the car would cost less to fix than the legal fees and missed time in their life dealing with the courts.

As far as the emotional side maybe this would be a concern for some, but I think that I would be right at ease after knowing I was not at fault.

That's beside the point, maybe the jaywalker was texting on the phone. Wanna jaywalk, shoulder the blame. If a drunk driver hits a jaywalker, there's two idiots for you.
