WILTON — Colin Fitch, the subject of a viral video showing a county sheriff's deputy ordering an illegal search earlier this month, is now facing a reckless endangerment charge for allegedly veering his vehicle into the path of a Wilton Mall security guard Monday.
Fitch, 20, of Saratoga Springs, was charged with reckless endangerment, second-degree harassment and trespass, according to state police. He was arraigned on the charges in Wilton Town Court on Tuesday and released from Saratoga County Jail on $500 cash bail later that evening.
Mall security said Fitch, who was previously banned from the mall, was escorted out of the building on Monday and then entered a vehicle. He then drove recklessly through the parking lot, nearly striking a security guard, troopers said. Watch: Saratoga County Sheriff slaps man and takes keys
Fitch and Adam Roberts were accosted by Saratoga County sheriff's deputies inside the Wal-Mart Supercenter around 1:50 a.m. on Nov. 7. After being frisked, the two men were escorted to the store's parking lot, where veteran Sgt. Shawn Glans ordered a search of Fitch's vehicle, which had a .22-caliber rifle in the back seat.
Fitch refused the search and then was allegedly slapped by Glans, who fleeced the keys from him and ordered another deputy to go through the car. The interaction was recorded secretly by Roberts and then uploaded to the sheriff's Facebook page later that day.
The video led to Glans being suspended from both his full-time job as a deputy and a part-time job with the South Glens Falls Police. He ultimately resigned both jobs and now faces a count of official misconduct. NYS Police

Fitch was banned indefinitely following a violation of the Macerich-owned mall's code of conduct in 2012, property manager Mike Shaffer said. Though he wouldn't disclose what Fitch did to receive the ban, he said the code is posted prominently at the mall's entrance and is intended maintain an enjoyable atmosphere for all patrons.
“The incident right now is in the hands of the state police,” Shaffer said, declining to discuss the matter further.
State Police spokesman Mark Cepiel said Fitch was with at least one other person when he was spotted by mall security and recognized as someone not allowed to be on the premise. He was escorted out from an area by the mall's food court.
The charges against Fitch all stem from his driving in the mall's parking lot, Cepiel said. He was arrested around 8 p.m., Tuesday, following an investigation and after state police investigators consulted with the Saratoga County District Attorney's office.
Cepiel wasn't sure why Fitch was banned from the mall. He said, however, Fitch's past run-ins with mall security were numerous.
“It appears [the ban] was because of previous incidents,” Cepiel said.
Last week, Fitch and Adam Roberts filed notices of claim against Saratoga County, with their lawyer contending their constitutional rights were violated by an illegal search of their vehicle.
