Awho criticizes others for copying and pasting from the internet, spent a great deal of time copying and pasting from the internet to give the illusion that his/her attempt to avoid addressing the actual points made.

DV, unlike you, I did not copy and paste tabloid stories.   I copied and pasted images and then using my own intelligence. I explained things to you that you do not have knowledge but you were speaking about.    Just like you speak about taxes, claiming that they are lower now than in the 1970's and you don't even have the intelligence to provide proof of your claim about taxes, you can't even find a trashy tabloid story to copy and paste.

And as one who actually has intelligence on this races, I probably lean 95% to Ward being at fault for his own stupidity, and only a 5% chance that Smoke intentionally tried to bump him, but since you have no knowledge on driving such a car you are not qualified to address that point (it is very different than when you drive your two mommies' car)

Finally, we still haven't heard a retraction or explanation from the person who started this thread by making the false claim that Mr. Stewart was arrested.

Sorry DV, but I stated that I heard this from someone WHO WAS PERSONALLY THERE and that statement had been going through the stands.  Of course, your lack of intelligence on the matter, you would not know about Tony's rep as a hot head, so initial reaction combined with Tony being questioned by the police can EASILY lead to other spectators to say that Tony was arrested.   Thus my husband's brother-in-law was there IN PERSON and those are the words he heard and he told us.    

And DV, obviously you have no reading comprehension ability....regarding "no explanation," I posted the following on August 10.   Go back and read and STOP ignoring the things that prove you wrong...

ROFL - You are so predictable and pathetic.  

You admit that you "copy and paste."  Of course, you assume that you are an expert and no one else no anything.  Then you throw in a red herring to change the topic and some UNINFORMED, INCORRECT personal attacks.  So my opinion of you has not changed.

When will you retract your false claim that Mr. Stewart was arrested?  Do I need to explain what the word "arrest" means again?  Or will you just continue to blow smoke out you behind as usual?

Did you have to look up those terms on the internet? That explains why you took so long to respond.

In the past, I have been to races at Lebanon Valley, Albany-Saratoga, Fonda, Daytona, Indianapolis and one out in central NY a number of years ago.  I never claimed to be an EXPERT.  I have been to races.  I have watched them on TV as well.  I have read and listened to commentary on the Stewart-Ward incident.  But I certainly have never claimed to be an expert.  Just trying to have a civil discussion like others on this board.

YOU are the one that insists on making everything personal and launching personal attacks.  Quite frankly, you are the one that comes across as mentally unstable and in need of anger management and some counseling to deal with your issues.

Just out of curiosity, who started this feud between DV and mikechristine1?  Because to be honest with you, and maybe it's just me, but I'm pretty much tired of it. Every thread they post in devolves into childish personal back and forth. Frankly, you both need to just STOP IT!!!!! It's not funny nor is it entertaining. If I want to experience this type of behavior, I'll go sit in a playground and listen to the 8 yr. olds go at it. Never thought I'd find something like that in a place where ADULTS are supposed to be discussing issues and such. Good grief.

In situations like this television and still photographers as well open the apertures on their lenses so as to allow the maximum amount of light. Using my trusty Canon AE1, I used the slowest shutter speed and the widest F-stop I could as well as a film designed for that type of photography. The resulting photo was amazing. You make a great point.

Another thing to consider is that Mr. Ward was to the right of Mr. Stewart's vehicle and between the darkness (night time), the dark clothing Mr. Ward was wearing against the dark dirt, shadows, -possibly - that Mr. Ward may have been in a "blind spot" (every vehicle has them) -- and a host of other possible factors.   All to say that this is precisely why it is a dangerous thing for a driver to leave his/her vehicle and walk toward moving vehicles on the track.

BTW - there was an interview with one of Mr. Ward's relatives. Apparently, Mr. Ward had a short fuse, too.  Let's face it - he was 20, wanted to impress others and probably thought he was invincible.

It is sad. It is tragic. But it was also something that could have easily been avoided if someone hadn't lost his temper and got out of his car.

MikeChristine -- He/she -- because it is a tag team husband/wife (supposedly - who knows).  He/she started it a few years ago by dragging my family into every topic.  He/she attacked some family members for being retired public employees, has insisted on posting lies about me and my family --- and has even resorted to creating several usernames claiming to be me or members of my family.  He/she has also attacked my church and its former pastor as well -- all in some pathetic and sick "scream" for attention.

I put him/her on ignore -- but recently, undid that feature in an attempt to try to have a civil discussion. Obviously, MikeChristine can not handle a civil discussion.

First, it would be up to a judge to determine if this prior history is admissible in court.  Depending on who you listen to (legal experts who have spoken on the matter over the past few days), it probably isn't admissible.

Second, I don't see anything in the video to show that Mr. Stewart was displaying "aggressive behavior" or expressing "anger."  He was racing his vehicle.

Third, the only person who seemed to be displaying "aggressive behavior" and expressing "anger" was Mr. Ward who left his car, walked TOWARD moving vehicles and appeared to be yelling angrily while pointing towards Mr. Stewart.


It will have to be determined that it was necessary for Stewart to gas the throttle as he was passing Ward.  Was he gassing it to avoid Ward?  Or was he gassing it to send a message to Ward, and miscalculated?  I find it difficult to believe that in a civil suit, Stewart will be exonerated 100% for his part in the tragedy.  Could Stewart have taken more evasive actions to prevent it?  

And based on the OJ civil trial, a lot more evidence was admissible than in the criminal trial.  OJ lost the civil trial.  And, I don't know where a civil suit will be filed, but if it is anywhere near the race track in central NY, it will be hard to find a jury that doesn't know Stewart's reputation of being a hot head.  If I was a juror on his civil trial, as it stands now, I would have a hard time being convinced that he didn't know how his car was going to behave when he gassed the throttle, and that he didn't do it to send a message to Ward.

You make some very good points.  Although, I think that it would not be an easy case for the plaintiff to make.  I am saying that based on several articles and items that I have read about proving liability in a civil case.

My thought is that Mr. Stewart would probably settle out of court if a civil suit was filed.  There would be some payment made to the family without determining how much either party was responsible for the tragedy.  I think that this would be the preferred route for both parties.  For Mr. Stewart, it would get the story out of the headlines or keep it from returning to the headlines.   For the Ward family, it would provide some compensation despite the fact that $$ will never undo the loss of a loved one.

I PERSAONLLY don't know if Tony Stewart was actually taken away in a police car, I don't know if he just sat in one on the track premises, I don't know if police stood somewhere talking to police.

But some spectators PERSONALLY saw something of those possibilities and started talking and when you're talking thousands of spectators, it only takes one person to say "Tony was arrested."


We know for an absolute undisputable FACT that he was questioned, then released.

I hereby admit Tony was not arrested, but the explanation for making the initial post  (around 2 in the morning after our guests left) comes from mouths of spectators who were PERSONALLY THERE as such statements went through the stands.  Thus my husband's brother-in-law heard that, verbally passed on to us what he had heard from others (and Tom only repeated what he heard---maybe DV, you should go out to Ohio and talk to him and demand that he tell you who told him that was in the stands, etc), and of course somewhere along the line spectators either personally saw Tony INSIDE a police car, PERHAPS being driven away, OR these people heard that Tony had left to GO TO the police station.   Obviously the first person who said something which started that information was wrong.   OR actually someone could have seen Tony talking to police and might have said "gee is he going to be arrested," and someone else doesn't hear all the words and then tells another that Tony was arrested.
