It seems that the Town Clerk is putting her own traveling friend at risk of committing a state crime

The Town Clerk has asked the Receiver of Taxes to REFUSE to Notarize Opt Out Forms forcing her to commit Class A misdemeanors

195.00 Official misconduct.
A public servant is guilty of official misconduct when, with intent to obtain a benefit or to injure or deprive another person of a benefit:
1. He/She commits an act relating to his/her office but constituting an unauthorized exercise of his/her official functions, knowing that such act is unauthorized; or
2. He/She knowingly refrains from performing a duty which is imposed upon him/her by law or is clearly inherent in the nature of his/her office.
Official misconduct is a class A misdemeanor.


Notary must officiate on request.
The Penal Law (§195.00) provides that an officer before whom an oath or affidavit may be taken is bound to administer the same when requested, and a refusal to do so is a misdemeanor.


Nice Sign on the doors of town hall  - why didn't the Town Clerk include the other languages spoken in town - this is NY - the melting pot

Well since you asked, why don't you do it? If I were a home owner tasked with the opt out chore, I would do it myself, but since I'm not, for me the point is moot. So hop on over to Town hall and be denied a notary service by anyone but the TC and then do the reporting yourself. Problem solved.

According to State Law all must sign if asked  - the individual notary may charge a fee  - these fee have a regulated maximum

Don't ask a Notary to verify who you are if you did not bring a photo ID

if they cannot identify you, you are asking them to commit a class E felony

the workers at the senior center will go door to door looking for the shut-ins....it IS after all a service to the seniors...
or we could call the office of aging and see what they think of the town's 'extortion' of seniors.....

the seniors were extorted a long time ago....now forgotten....

Well then can I assume you've already reported the thieves or are preparing to do so? If you have good for you. Thankfully I don't have to deal with it so I'm leaving it to others to do the reporting the extortion to the proper authorities. And once again if that's in your plans good for you.

it's up to the government 'service' to provide access.....TO EVERYTHING....not just wheelchair ramps to get into the
building......

it would behoove those who voted it in to hop in their cars go door to door,,,,inform and provide the service for the
choice of a taxpayer to opt out......

it falls into the category of providing service in multiple languages.......so that ALL understand.....

Oh so NOW you AREN'T going to report it. Make up your mind. See, your attitude is one of the things that got us here in the first place. You apathetic fool!! You come here pissing and moaning saying this and that and the other thing, about how bad and evil they are, but when presented with an opportunity to expose the devils for what they are you crawl back into your hole and use your "same old thing" argument. sh*t OR GET OFF THE POT!!!! But don't come HERE and whine about it any more.

And just as an addendum, although I don't use the brush pickup, I have emailed the the bastards (all of them) at Town Hall, expressing my displeasure. I have also sent copies to our legislators, (at the county, state and federal levels) expressing my displeasure. I have asked for investigations into their possible malfeasance. I don't expect answers from any of these people, but at least I make an effort. You, you just pass on any rumors from your fictional "donut shop" and whine in cyberspace.
