It could be that someone had a gripe with this guy and dropped a dime on him and it started the wheels in motion. There was a case in Schenectady where a neighbor said that his next door neighbor threatened him, no witness, he had his guns taken away for almost a year and had to get a lawyer to get them back at considerable cost to him.

Try going to the lawyers site in Buffalo who is handling the lawsuit, there has only been 2 cases so far but it may be just the beginning and the story has been verified by the Blaze and there are pages of other websites carrying the story. Google Jim Tresmond he has handled 2nd amendment cases before.


All the Blaze does is rehash the story. As if that gaggle of douche nozzles would be impartial anyway.
Cops didn't scan some drug store's database, and decide to randomly take some one's gun.
The only time this happens, is when a mental health professional reports someone that might be danger to themselves, or others.
It's been going on for decades, and no rational personhas a problem with it.

You people blather on about how the solution is not in making new gun laws, but rather, addressing mental health issues, and when they do what you recommended, you throw a hissy fit.

Actually, they don't really care because all they care about is public image, and votes.
Any sane person knows it's impossible to confiscate the 270 million guns that are currently privately owned.

They don't care if you wear them as earrings as long as their carreer advances.
Besides, do you really think the cops are anxious to go around trying to disarm angry people?

That law has been in effect for decades.
He's just trying to capitalize on the current controversy to make a name for himself.


So your saying the story is legit, and that HIPPA laws have been violated all along to preemptively disarm Americans on psychotropic drugs?  

This is just a PR stunt because of the current national debate?

I can agree with that.  But just because it was going on out of the public eye because it didn't fit in the news cycle doesn't make it ok.

AMHERST, N.Y. (WIVB) - An Amherst man had his guns confiscated by the state, which claimed he was too dangerous to own them.

"David", a 34-year-old college librarian, had no idea State Police were investigating him and would recommend his pistol permit be suspended until he got the notice in the mail. Now he has to fight to get it back.

Attorney James Tresmond said, "'Due process' should come before the suspension. That is where due process comes in - before your rights are taken, due process must occur. That is our Constitutional right, not the reverse."

After meeting with Erie County's Licensing Officer, Supreme Court Justice William Boller, Tresmond says State Police recommended David's license suspension based on his prior use of a widely-prescribed anti-anxiety medication. Tresmond says the new SAFE Act requires mental health providers inform authorities.

"And that anybody that was on medication or being seen for mental health treatment, they had to report that to the State Police," Tresmond said.

Attorney Mike Deal, who is involved in an unrelated SAFE Act case, says the new gun control measure also added a reporting provision to Mental Hygiene Law for persons with gun permits.

"If they believe that person is - I want to get the language right - likely to engage in conduct that would result in serious harm to self or others," Deal said.

But is David's HIPAA privacy being violated?

Tresmond said, "Federal law pre-empts state law. The state can give you more rights, but they can't give you fewer rights than federal law gives you."

The irony is that the NYS government determines that a person on FDA approved drugs is too dangerous to own a gun...and the FDA determined the drug to be safe.  

Now people that collect guns or want one for personal protection will forego treatment.  

Yup, the SAFE Act is keeping kids safe by discouraging people with mental illness from seeking treatment.

Reporting a dangerous person is not a violation of the HIPPA laws, and it's been done plenty of times in the past, and people contest the seizures on a regular basis, usually by getting a second opinion from another doctor, and presenting it to the court.

This has been going on for quite some time, and isn't limited to guns.
They also can take your kids, or your license away for the same reason, and have been doing so for decades.

The new law allows your private medical information to be given to the NYS Police if you have a pistol permit in violation of the federal HIPPA law. The difference is the state used to take your pistol permit after you committed an offense not before.

The government has taken kids or license BEFORE committing an offense?  I know allegations of child abuse will trigger CPS to remove children from a home but I've never heard of a doctor disclosing medical treatment to the police to trigger it.  Typically the person is charged with an offense.

If this guy was deemed intelligible to possess pistols that he already owns because he is a threat, then surely he should be deemed intelligible to parent his own children should he have them.  

These are all moot points anyways, since it never happened.

I know people in the field.
The reason you may not have heard of it, is that preemptive actions don't make the news, the way a crime might.
Kids are taken away all the time due to unsafe environment.

The most serious offense and one that should concern ALL of us..........is the blantant breech of the 'so called' HIPPA laws. Who exactly is privie to this information cause family memberS are NOT!! Even POA'S have to sign their life away in order to view any 'mental issue' documents. Not even health care provider are privie to that information when they are the ones taking care of them.

the attorneys should be questioning HOW and WHO has access to this PRIVATE info.

Lesson here...........don't go to the docs and if  ya do...ask them to keep a 'second' set of records that don''t go to 'GOV ALMIGHTY'. (there are docs that do that these days)
