Syracuse, N.Y. -- New York lawmakers appear poised to vote on stricter gun laws, a move that would make the state the first to enact more weapons bans in the wake of shootings in Newtown, Conn., and Webster, N.Y., according to the leader of the New York State Assembly.

"I believe we're very, very close to an agreement on a bill," said Assembly Sheldon Silver, D-Manhattan, today in Albany. "We are going to ban assault weapons. We are going to eliminate all the loopholes that existed previously."
Silver said one of the few outlying issues involves how to provide extra security at schools and how to adjust state aid to pay for that.

Silver outlined some of the changes:

•Magazine clips would be limited to seven casings, down from the current 10.
•The agreement includes a "significant expansion" of Kendra's Law, giving judges more latitude to provide services for mentally ill people.
•It would ban semi-automatic weapons made before 1994. Current law allows rifles manufactured before 1994 as legal.
•The state would create a rifle registry.
•The bill includes penalties for those who commit crimes with guns.


The law would likely not require a new background check among private sales, Silver indicated in response to questions.

Sen. Jeffrey Klein, D-Bronx and leader of the Independent Democratic Conference, also said a vote was likely today, according to his spokesman.

Silver said a vote today would require a "message of necessity" from Gov. Andrew Cuomo, a Democrat who has pledged to pass the first stricter gun law in the nation in the wake of last month's deadly shootings. Silver said he expected the governor to push for the quick vote.

"It is an emergency," Silver said.

Other details of the proposal, as reported by the Albany Times Union's Jimmy Viekind, include:
•Adjusting the definition of a banned rifle so that any single characteristic (a telescoping stock or pistol grip, for example) would qualify that weapon as banned. Existing weapons would be grandfathered in but could not be transferred.
•The state's pistol permit requirements would be standardized; currently rules differ among counties.

A new Pew Research poll finds "there are clear areas of agreement when it comes to a number of gun
policy proposals.
~ 85% of Americans favor making private gun sales and sales at gun shows subject to background checks,
with comparable support from Republicans, Democrats and independents.
~ 80% support laws to prevent mentally ill people from purchasing guns, with broad support across party lines."

~ 67% favor creating a federal database to track gun sales,  Democrats (84%,Republicans (49%).
~ 55% favors a ban on assault-style weapons; Democrats 69%, Republicans 44%.
Similar divides exist to banning high-capacity ammunition clips or the sale of ammunition online."
