IRS aims to clarify investment income tax under healthcare law

(Reuters) - The Internal Revenue Service has released new rules for investment income taxes on capital gains and dividends earned by high-income individuals that passed Congress as part of the 2010 healthcare reform law.

The 3.8 percent surtax on investment income, meant to help pay for healthcare, goes into effect in 2013. It is the first surtax to be applied to capital gains and dividend income.

The tax affects only individuals with more than $200,000 in modified adjusted gross income (MAGI), and married couples filing jointly with more than $250,000 of MAGI.

The tax applies to a broad range of investment securities ranging from stocks and bonds to commodity securities and specialized derivatives.

The 159 pages of rules spell out when the tax applies to trusts and annuities, as well as to individual securities traders.

Released late on Friday, the new regulations include a 0.9 percent healthcare tax on wages for high-income individuals.

Both sets of rules will be published on Wednesday in the Federal Register.

The proposed rules are effective starting January 1. Before making the rules final, the IRS will take public comments and hold hearings in April.

Together, the two taxes are estimated to raise $317.7 billion over 10 years, according to a Joint Committee on Taxation analysis released in June.

To illustrate when the tax applies, the IRS offered an example of a taxpayer filing as a single individual who makes $180,000 in wage income plus $90,000 from investment income. Calculating Modified Adjusted Gross Income (MAGI):

Modified Adjusted Gross Income (MAGI) is calculated by adding back certain items to your Adjusted Gross Income. Your Adjusted Gross Income (AGI) can be found on line 38 of your Form 1040; line 22 of your Form 1040A; or line 36 of your Form 1040NR.

The following items must be added to your Adjusted Gross Income (AGI) to calculate your Modified Adjusted Gross Income (MAGI):

Traditional IRA contributions that were deducted.
Student loan interest amounts deducted.
Tuition and fees deducted.
Domestic production activities deducted.
Foreign income or housing costs excluded on Form 2555.
Foreign housing deduction taken on Form 2555.
Savings bond interest excluded on Form 8815.
Adoption benefits from an employer excluded on Form 8839.
Worksheet 1-1, found on page 17 of IRS Publication 590, provides information for a step-by-step calculation of Modified Adjusted Gross Income (MAGI).

Examples:
The Hope Scholarship tax credit is not available to taxpayers filling jointly who have a Modified Adjusted Gross Income (MAGI) above $114,000 for 2007.

ALBANY — Albany County lawmakers trimmed the tax hike in their proposed 2013 budget to 7.6 percent Thursday night, down from 8.9 percent, as the fate of Monday night's vote to override the state tax cap remained uncertain.

The Audit & Finance Committee approved the roughly $1.1 million in cuts alongside a measure that would allow the county to exceed the 2 percent cap on property tax growth for the second time in its two-year existence.

But two dissenting votes came from Democrats — Tim Nichols of Latham and Charlie Dawson of Glenmont — who are said to be among a half-dozen in their 29-member caucus standing in the way of the 24 votes needed to exceed the cap. Help from the 10 Republican and Conservative legislators is unlikely. Loudonville Republican Peter Crouse also opposed exceeding the cap.

Tuesday's cuts came largely from overtime, most notably $200,000 from the sheriff's department. The legislature also cut $300,000 from anticipated debt payments.

In a move that may help sidestep a veto by County Executive Dan McCoy, the committee also moved millions of dollars it had restored to McCoy's budget to fund the county nursing home for the second half of next year into what amounts to a contingency fund.

Lawmakers restored the money in case McCoy's deal to lease the facility to a private firm falls through or is rejected by the legislature. McCoy threatened last week in a memo to veto the budget because he said it did not give him leeway to continue to negotiate with the company, Upstate Services Group, in good faith.

McCoy told the Times Union Thursday he would let funding to stand so long as it was in a contingency account that would let him to use it for the county's financial commitments should deal go through.

A final vote on the budget and tax cap is expected Monday.

The most recent version of the legislature's budget does not include a controversial plan to charge cities and towns for their local share of community college tuition for students hailing from inside of their borders.

(June 5, 2012) – UnitedHealthcare has launched myHealthcare Cost Estimator, a new integrated online service that brings a retail shopping experience to health care and helps consumers find quality care while being able to estimate the cost of more than 100 common treatments and procedures with maximum accuracy. The new online service is more precise than calculators that may only rely on old claims data, and often from only a handful of employers. myHealthcare Cost Estimator, available to more than 14 million people enrolled in UnitedHealthcare health benefits plans, draws on the company's actual contracted rates with physicians, hospitals, clinics and other health care providers in 47 markets, giving consumers highly accurate pricing estimates.
