TOWN OF ROTTERDAM
ZONING BOARD OF APPEALS AGENDA
SEPTEMBER 19, 2012
PLEASE TAKE NOTICE, that a public hearing will be held by the Rotterdam Zoning Board of
Appeals on Wednesday, September 19 , 2012 in the V. Dalton Bambury Hearing Room, at the
John F. Kirvin Government Center, 1100 Sunrise Boulevard, Rotterdam, New York at 7:30 p.m.
to consider the following applications:
1) Donald and Denise Tefoe – 1172 Countyline Road, Rotterdam, NY, Tax Map #70.00-
3-17 located in the Agriculture (A-1) Zoning District.  Petitioners respectfully request
that they be granted variances as prescribed in the Town of Rotterdam Zoning Code
being Chapter 270-138 entitled “Accessory Structures and Uses.”  The applicant would
like to construct a 24’ x 25’ detached garage the rear yard of an existing single family
residence.  The variance request(s) are as follows:  Chapter 270-138(c) “Lot Coverage”
states with respect to private garages, the floor area for each stall for the enclosed parking
or storage of private motor vehicles shall  not exceed 300 square feet.  Calculations
computed for square footage shall be based upon exterior foundation dimensions.  No
accessory garages shall exceed a maximum height of 15 feet in all existing zoning
districts.  The proposed detached garage is 600 square feet and the existing detached
garage is 400 square feet making the total garage space 1,000 square feet, which is 100
square feet over the allowed size of 900 square feet.
2) Alice Ryan – 2929 Wellington Avenue, Rotterdam, NY, Tax Map #48.15-8-20 located
in the Single Family Residential (R-1) Zoning District.  Petitioner respectfully requests
that she be granted variances as prescribed in the Town of Rotterdam Zoning Code being
Chapter 270-138 entitled “Accessory Structures and Uses.”  The variance request(s) are
as follows:  Chapter 270-138 (B)(2) “Detached structures” states that every detached
accessory structure shall be located no less than five feet from a side or rear property line.
The applicant would like to demolish an existing 12’ x 18’ detached garage and construct
a 24’ x 24’ detached garage the rear yard of an existing single family residence within
four (4) feet of the side property line which will require a variance of one (1) foot for the
for the side property line.
3) Estate of Michael F. Roman Jr. – 428 Gordon Road, Rotterdam, NY, Tax Map
#38.00-1-8.1 located in the Agriculture (A-1) Zoning District. .  Petitioners respectfully
request that they be granted area variances  as prescribed in the Town of Rotterdam
Zoning Code being Chapter 270-31 entitled “Yard and Property Line Requirements.”  
The applicants are requesting variances in order to allow for a two (2) lot subdivision to
facilitate the construction of a single family residence on newly created 5.62 acre lot and
the creation of a 1.17 acre lot with an existing single family residence located at 428
Gordon Road.   Chapter 270-31(d) states that the “Front property line shall be a
minimum of 150 feet.”   The applicants are seeking permission to create a 5.62 acre
parcel with a front property line of 75.18 feet which will require a variance of 74.82 feet.
4) Michael E. Caffarella (Owner) and Larry Martinelli (Contract Vendee)  – 2532 Van
Dyke Avenue, Rotterdam, NY, Tax Map #48.20-6-15.1 located in the Single Family
Residential (R-1) Zoning District. .  Petitioners respectfully request that they be granted
area variances as prescribed in the Town of Rotterdam Zoning Code being Chapter 270-
21 entitled “Lot area,” and Chapter 270-33 entitled “Yard requirements.”  The applicants are requesting variances in order to allow for a two (2) lot subdivision to facilitate the
construction of a single family residence on newly created 4,687 square foot lot located
on Laura Street and the creation of a 9,699 square foot lot with an existing single family
residence located at 2532 Van Dyke Avenue.  The variance requests are as follows:

5) John and Norine Adamec – Terminus of West Lucille Lane, Rotterdam, NY, Tax
Map #58.19-2-3.11 and 58.19-2-22.1 located in the Single Family Residential (R-1)
Zoning District.  Petitioners respectfully request that they be granted area variances as
prescribed in the Town of Rotterdam Zoning Code being Chapter 270-33 entitled “Yard
requirements.”  The applicants are requesting variances in order to allow for a proposed
seven (7) lot major subdivision.  The applicants are proposing improvements to the
terminus of West Lucille Lane to facilitate the creation of three (3) lots.  The variance
requests are as follows:
    Existing West Lucille Lot #1 = ±8.38 acres  
    Required Existing Proposed Variance
  Lot Width 100 feet  64.04 feet 64.04 feet 35.96 feet
    Proposed West Lucille Lot #2 = ±2.28 acres
    Required Existing Proposed Variance

    Required Existing Proposed Variance
  Lot Width 100 feet  156.4 feet 78.1 feet 21.9 feet
