I don't think they will be that stupid to make only one charge because if there isn't enough evidence to convict on 2nd degree murder Zimmerman will walk free but give the jury options of lesser charges and they may convict him of manslaughter or felonious assault.

The trial will be conducted on the evidence at hand. The jury will find guilty or not by the evidence presented. And if he left it in his pocket, no one MIGHT have died either. The gun didn't jump in his hand and pulled its own trigger. Guns are an instrument, an effective one, but nothing more. 33% of murders in this country are committed with an instrument other than a gun.
