Rotterdam — Former Rotterdam supervisor Frank Del Gallo was right in denying Diane Marco wages she claimed were due, according to a Tuesday, Jan. 17, ruling.

#Glenville Town Justice Brian Mercy denied Diane Marco, former project coordinator for the Rotterdam senior center and the new Town Clerk, past wages totaling $519.23 she claimed was due, which Del Gallo denied.

#Marco received a letter from Del Gallo on her termination Feb. 28, 2011, after 14 months on the job and her reappointment at the beginning of the year. The termination had divided Town Board members and drew sharp criticism from residents.

#Marco served the appointed position at the town’s discretion and Del Gallo’s dismissal wasn’t argued legally. Marco’s lawsuit claimed she worked 11 hours on Feb. 26, 11 hours on Feb. 27, and 9.5 hours on her last day of employment, for a total of 31.5 hours, for which she wasn’t compensated.

#Del Gallo claimed he explained to Marco that she couldn’t be paid for the condensed hours, which were unauthorized.

#“I don’t know what the heck her intentions were,” Del Gallo said today. “She just decided she was going to work a week in three days and she couldn’t do that. I tried to explain that to her but she didn’t listen.”

#Marco could not immediately be reached for comment on Thursday morning. She was elected Town Clerk of Rotterdam in the November election.


I wonder why Ms. Marco wasn't at work Thursday morning.  Did her car break down and she couldn't make it all the way down the road to town hall?  Maybe she should have called the former sheriff or the former police chief for a ride in the vehicle of one of Rotterdam's Finest?

And if this case came because she was doing things that were inappropriate, hence the reason she was fired from the Senior Center, what happens if she is in an elected position and doesn't have the office open during the appropriate hours?

The town has already been through that scenerio, we pay the TC for as long as she wants to stay out of work and hire someone else to do the job until she comes back to work.

DM is clearly over her head as rotterdam tc.

Heard from some rotterdamians that she isn't even at the window....she's somewhere in the 'back'!

What do you expect.... inappropriate behavior and devious events are nothing new.

The fact is that she got caught this time.....and there will be more.....

The full story cannot be divulged, probably,  because of who is involved....just remember this.

DM was not in charge of a certain part of the Center from June 2010 thru Dec 2010...and was

reappointed 2011 under the scrutiny of many residents.....in an underhanded, pre-planned

move after the Executive mtg at the Jan 2011 meeting, she was reappointed.....that is another event

that has to be answered....may have been the same scenario as the most recent one...

The Seniors have been duped along with residents of this Town....

The grievances filed in 2010 were truthful .... and that was not all that was going on with DM.

PS...notice the residents did not read this decision until yesterday and most will today...

Wonder how they feel now???.....or, will it just go unnoticed like everything else...

Shame that monies are being paid to someone who is not qualified and can get away with it

because of who is in "charge".....honesty does not exist any more...just favors and who

someone knows....that's why the state that exists in this Town goes on....

The residents will soon find out just how broke and in debt the Town is....by then, it is too late.

Rotterdam's town hall will have to go into 'damage control' mode!! Something they are always doing. Always putting out fires. Everything is a crisis. Cover ups! BUT....that is rotterdam after all!

And the rotterdamians are paying dearly!!

GFY! Clerk Marco IS at work -- each and EVERY day as she is fully immersed in improving the office so that ALL of Rotterdam's taxpayers will have their needs met.


And the only way you would know this is if either A: you ARE Diane Marco (and blogging on company time) or B: you are a town employee, most likely right in Ms. Marco's office and are able to confirm this.  NO RESIDENT goes there every day to check, so you would have to be a worker, and by being on this blog during company time, wasting taxpayer money being here (on the blog).

Hamburg is supposedly an independent blogger.....we all know different...

It is an alias of DVOR.....who is devoted to the REGIME......

And being in government does not exempt anyone from becoming a political pawn or hack.

And receiving any wages it's expected that you WILL work for it....government or not....

The taxpayers of this Town have been duped enough by the whole outcome of the election.

AND only time will tell .....it seems this government is not transparent....

The verdict is in. Diane Marco gets NOTHING. She worked more hours than authorized and looks like an idiot being laughed out of court. Diane Marco actually puts double dipper Taxin Tonko to shame. Another DEM public "servant" interested in one thing fattening her bank account on the taxpayer teat. Anyone that voted for her should be tarred and feathered. How do you recall a town jerk?

I encourage her to FIGHT and APPEAL this unjust verdict yet in fact the Judge DID agree that she WORKED those hours.....   If Mr. DelGallo had not fudged the books then her pay would be awarded........    It WAS a technicality.

No dumba$$, it's called the legal system. It's where two parties present evidence and a judge rules based on the evidence and the law. The judge clearly stated she presented no evidence to support her claim. Why wouldn't she have known that before she filed the claim, wasting taxpayer money for a baseless claim. Nice going TC!  Lost any respect I had for her! Used the legal system and taxpayer services for a personal grudge.

When you elect a political pig expect this type of behavior. It's not enough she worked both in the City/RSC she also has to sue for money she not owed. She fell on her face with her money grab. Bravo to the Judge for denying her false claims. Diane Marco is doing a terrible job as Town Jerk and only seems concerned with hiring more brain dead lobs. She will be dumped in 2013.
