A SWAT team must have a warrant from a judge and the judge must have probable cause to issue a warrant, even then SWAT cant use lethal force unless the person is attempting to harm them or others at the time of arrest. That's a big difference from dropping a bomb on somebody because he was on some DC blacklist.

Mich. militia members cleared of charges that accused them of plotting war against government

DETROIT — A federal judge dismissed the most serious charges Tuesday against seven members of a Michigan militia who were rounded up as homegrown extremists accused of plotting war against the U.S., saying their expressed hatred of law enforcement didn’t amount to conspiracy against the government.

The decision is an embarrassment for the government, which secretly planted an informant and an FBI agent inside the Hutaree militia four years ago and claimed members were armed for war in rural southern Militia.
U.S. District Judge Victoria Roberts granted requests for acquittal on the most serious charges: conspiring to commit sedition, or rebellion, against the U.S. and conspiring to use weapons of mass destruction. Other weapons crimes tied to the alleged conspiracies also were dismissed.

“The judge had a lot of guts,” defense attorney William Swor said. “It would have been very easy to say, ‘The heck with it,’ and hand it off to the jury. But the fact is she looked at the evidence, and she looked at it very carefully.”

They still face some weapons charges but I guess they will be dropped as well or reduced to nothing. I said from the beginning they had jack sh1t on them, those who read the evidence laughed at it because it was such a joke.

An unfortunate decision.  The FBI will now have to wait till someone dies from their planned pipe bombs instead of
stopping the attack and then trying to prosecute for conspiracy.
